Dear Ms. Reid:
Thank you for the recent submittal for this special use permit application. Please find review
comments included in this letter.
Please see the attached resubmittal schedule for a list of dates on which you can submit your
revisions and responses to review comments (below and attached), as well as for possible
Planning Commission dates (please note that the listed dates are the earliest possible, but actual
dates need to be selected to suit the revision schedule for each project.)
COMMENTS
Planning (Scott Clark)
• Please supply a to -scale conceptual plan showing the location and size of the existing and
proposed facilities that relate to this use (entrances, parking, any new structures, etc.).
Any eventual approval would require such a plan, as it would be conditioned on the
development and use of the site being in accord with that plan.
• Please specifically delineate the areas to be used for any outdoor activities (and list those
planned activities) so that we can analyze potential impacts on the site and on
surrounding properties.
• Do you plan to have outdoor amplified music or sound at any of the events? We would
recommend against it due to potential impacts on adjacent properties. Similar special use
permits are often approved with a condition prohibiting outdoor amplified sound.
• What outdoor lighting is planned for the site?
• What would the hours of operation be for the special- events business?

What other uses beyond special events do you have planned for the site? Cumulative
impacts of multiple uses (if any) would be an important part of this permit review.
We recommend that you contact the Virginia Department of Health to establish whether
or not the house currently has what would qualify as a "commercial kitchen." The
supplemental regulations for the "special events" use require that there be no commercial
kitchen on the site. Although you could request a waiver of that requirement from the
Planning Commission, it would be a better assurance of the limited scale of this use to
either not have such a kitchen or to downgrade it to the point that the Health Department
no longer considers it "commercial."
A general note: This proposed use would be located in the County's Rural Areas, which
are meant to support agriculture, forestry, conservation, and related uses. A major issue in
this review will be whether the character and scale of this use is appropriate in its rural
surroundings, or is more commercial in nature. A major part of the Board of Supervisors'
decision process is whether or not they can find that the proposed use is appropriate in its
zoning district.
Also: While this is a Rural Areas property, the proximity of several residences means that
the impacts of the proposed uses on neighboring properties will also be a significant
issue. Any changes to or limitations on the proposed use that reduce noise, light, traffic,
and other impacts on the neighboring properties will help to alleviate that concern.
Please note that I have attached the supplement regulations for this use (section 5.1.43 of
the Zoning Ordinance). Please review those requirements and verify that none of your
proposed uses would conflict with them.

Current Development — Planning (Bill Fritz)
It appears that this use will require additional parking. Therefore, a site plan (or site plan
waiver) will be required for this use. The information submitted to date is substantially
below the level of a site plan. For a waiver to be acted on the applicant needs to make the
request and state which provisions of Sections 32.5 and 32.6 they are asking to be
waived. (The wavier process is contained in Section 32.3.10.)
The additional parking will need to meet the design standards for parking (such
as:paving, striping, sizing, slope and curb and gutter) unless the applicant is granted a
waiver of these standards as allowed by Section 4.12.2(c). If the applicant is seeking a
waiver they will need to submit the request, provide information on the alternative design
desired and submit a justification using the criteria of Section 4.12.2.(c).
All other design requirements of the ordinance will also have to be met. The design of
the travelway (driveway) and entrance onto the state road will likely require upgrading.

County Engineer (Glenn Brooks)
I have no objection to the proposed special events use of the property. With the
frequency of events proposed, I recommend a formal parking area on -site. This may
entail site plan requirements.
Inspections (Jay Schlothauer)
• No objection.
Fire /Rescue (James Barber
• No objection. Must comply with the Virginia Statewide Fire Prevention Code. Final
approval is subject to field inspection and verification.
Virginia Department of Health (Josh Kirtley)
Department of Health comments will be provided as soon as they are available. However,
we recommend that you contact Mr. Kirtley at the Charlottesville office of the
Department of Health as soon as possible, so that you can describe your proposed
operations to him and get his advice on how to proceed with planning for water - supply
and septic issues.
Virginia Department of Transportation Joel Denunzio)
The existing traffic circulation off Route 692 has one entrance and one exit. The existing
entrance has limited sight lines to the left if it is ever used as an exit onto Route 692 and
the sight distance to the right is adequate. The existing exit has some tree limbs to the left
that need trimmed for sight lines and to the right there is the need for some backslope
grading between the ditch and rock wall.
Please contact the Land Use Permits VDOT office to set up a time to meet if needed.
A Land Use Permit will be required for any work within the VDOT right of way.

I have reviewed the initial submittal and have the following comments:
1. The applicant needs to either state in writing that they are not proposing the use
involving operation of a non - profit sustainability organization or they need to clearly state
what they use involves. It is probable that this use will involve a separate special use
permit.
2. Please also ask the applicant to clarify if the home will also be used for accessory tourist
lodging. If so, we will need to consider the cumulative impact with the proposed special
events use.
3. As part of this review and with further comment from VDOT, please clarify which road
improvements (if any) are required. As we mentioned in the preapplication conference,
the record is not clear whether this previous condition was met. We understand there
was a sight distance issue.
4. Please have the applicant submit a parking study outlining the number of parking spaces
that will be required to support the special events. (See the parking standards in Section
4.12.6)
5. A concept plan [Section 5.1.43 b (1)] or site plan of some sorts will be necessary to
clarify the entrance and parking.
6. Please have the applicant clarify whether a commercial kitchen is proposed. If it is, the
applicant should submit a written waiver request [Section 5.1.43 e(4)].
