Please find review comments included in this letter. Please see the online resubmittal schedule for a list of dates on which you can submit your revisions and responses to review comments (below and attached), as well as for possible Planning Commission dates (please note that the listed dates are the earliest possible, but actual dates need to be selected to suit the revision schedule for each project.) COMMENTS Planning (Scott Clark) Thank you for the detailed response to the June review letter. I have no further questions beyond those raised by the other reviewers below. However, I would point out that most of those issues are not resolved, but need to be dealt with in detail before this proposal goes to a public hearing. Zoning (Ron Higgins) • I am encouraged by the changes to reduce the number of participants and the level of activities. However, one answer to the question about weddings for church members was that the "church would like to eventually rent the facility for weddings for the general public." This begins to sound too much like a commercial event center that might not be within the church related activities, although weddings would likely fall within that use. SP2009 -025 Dover Foxcroft (Church Uses) Page 2 November 2, 2010 • Also, given the size of some activities and the need for overflow parking, this sounds like an intensification of uses that would generate entrance changes, thereby generating the need for a site plan. Current Development — Planning (Bill Fritz) Based on the comments of Ron Higgins dated 10/28/10 it appears that the proposed use will require both additional parking and changes to the entrance. Based on that information a site plan (or site plan waiver) will be required. The information submitted to date is substantially below the level of a site plan. For a waiver to be acted on the applicant needs to make the request and state which provisions of Sections 32.5 and 32.6 they are asking to be waived. (The wavier process is contained in Section 32.3.10.) The additional parking will need to meet the design standards for parking (such as: paving, striping, sizing, slope and curb and gutter) unless the applicant is granted a waiver of these standards as allowed by Section 4.12.2(c). If the applicant is seeking a waiver they will need to submit the request, provide information on the alternative design desired and submit a justification using the criteria of Section 4.12.2.(c). County Engineer (Glenn Brooks) • It is recommended that the parking area and entrance road meet the requirement of the zoning ordinance and water protection ordinance for a site plan. • As a matter for consistency, this use would appear to meet the threshold of 250VPH on a state controlled highway for a traffic impact analysis according to the VDOT administrative guidelines. Historic Resources (Margaret Maliszewski) Department of Historic Resources (DHR) files indicate that a number of historic resources have been identified at this site. The site was surveyed in 1979 and re- surveyed in 2006. By 2006, some ruins identified in the earlier survey (icehouse, blacksmith shop and kitchen) had been lost. The remaining resources have not been formally evaluated by DHR for eligibility for inclusion in the state or national registers. The most recent revision to this plan indicates that no construction, grading or demolition are associated with this proposal. The applicant is encouraged to maintain the historic and architectural integrity of the remaining cultural resources at this site. Inspections (Jay Schlothauer) • Implement the building alterations noted in October 15, 2010 letter to Dan Carlton from Jay Schlothauer. SP2009 -025 Dover Foxcroft (Church Uses) Page 2 November 2, 2010 Fire/Rescue (James Barber • Must comply with the Virginia Statewide Fire Prevention Code. Final approval is subject to field inspection and verification. Virginia Department of Health (Josh Kirtley) I would say that the Church should be working closely with a PE as far as the septic system is concerned. The PE needs to evaluate their existing system and determine if it is acceptable or the PE needs to design additional septic capacity to bring the drainfield into compliance with the proposed use(s). I would leave it to the engineer to use his or her best professional judgment in determining what needs to happen with the septic. I am more than willing to work with the PE and would help them however I can. To date, I have not spoken with a PE about this .... Another issue that could arise would be the water supply. Given that weddings were mentioned in the attached comments section, I would question whether or not the Church would be governed by the Office of Drinking Water because they may meet the criteria for a "public well ". Basically the deciding criteria is centered on how many people will be using the facility and the time period associated with the use. I am willing to sit down with the applicant and try to determine whether or not they would fall under those guidelines as called for by the Office of Drinking Water. I would also like to add that the Health Department could be involved with other activities associated with this use. If the church is going to have a daycare or if the church is preparing large quantities of food, etc, then the Health Department would be involved. The reason that I am bringing this up is that I am unsure as to what exactly the applicant is proposing since the SP has changed. I would encourage that if the applicant to work closely with the Health Department if they may be proposed another use that we would be involved in. Virginia Department of Transportation Joel Denunzio) I do not have any records of the VDOT inspection that is referencing a visit by Chuck Proctor. I would like the applicant to contact me so I can schedule an inspection of the existing entrance for this proposed use. Please let me know if you have any questions or need any more information.
