This letter is being provided to notify you as an adjoining property owner to the above listed property that a
special exception application has been submitted for an exception from County Code § 18-5.1.28 requirements
on Parcels 055CO-00-00A-03700 and 055CO-00-OA-03800 that relate to the required minimum setbacks and
minimum lot size requirements.
PROJECT: SE202300036 Orchard Acres - Clean Earth Fill
PROPOSED: Pursuant to County Code § 18-5.1.28(a)(7) and § 18-5.1.28(a)(9), the applicant has applied for an
exception from County Code § 18-5.1.28 requirements on Parcels 055CO-00-OA-03700 and 055CO-00-OA-
03800 to waive the minimum setback of 75 feet from all property lines in residential zoning districts and the
100-foot minimum setback from dwellings on adjacent properties and to reduce the minimum lot size to below
the five (5) acre minimum.
ZONING CATEGORY/GENERAL USAGE: R-2 Residential
SECTION: §18-5.1.28
COMPREHENSIVE PLAN LAND USE/DENSITY: Neighborhood Density Residential- low -density residential
development patterns with neighborhood -scale commercial, retail, and institutional uses.
ENTRANCE CORRIDOR: No
LOCATION: Lots 37 & 38
TAX MAP/PARCEL: 055CO-00-OA-03700 and 055CO-00-OA-03800
MAGISTERIAL DISTRICT: White Hall
This petition will be reviewed at the ALBEMARLE COUNTY BOARD OF SUPERVISORS MEETING ON
WEDNESDAY, FEBRUARY 21, 2024. The meeting will also be conducted through electronic communication
means.
Special exceptions must be acted on by the Board of Supervisors, and may be granted after notice to abutting
property owners and upon consideration of whether:
I. There would be any adverse impact(s) to the surrounding neighborhood;
ii. There would be any adverse impact(s) to the public health, safety, or welfare;
iii. The proposed special exception would be consistent with the Comprehensive Plan and any
applicable master or small -area plan(s); and

iv. The proposed special exception would be consistent in size and scale with the surrounding
neighborhood.
