Marotta, Senior Planner Re: SUB2010 -133 Vest BLA The Zoning and Current Development Division of the Albemarle County Department of Community Development will recommend approval of the proposed plat referred to above when the following items have been satisfactorily addressed. (The following comments are those that have been identified at this time. Additional comments or conditions may be added or eliminated bases upon further review.) Each comment is preceded by the applicable reference to the Albemarle County Code. 1. [Sec. 14- 302.A.10] Development Rights. COMMENT: According to my research, TMP 92 -54 has 3 development rights (per Plat signed June 23, 89). Because the residual parcel proposed will be less than 21 acres, it must retain a development right. You can convey 2 DR to TMP 92 -55E (to be use inside the 1980 boundaries of TMP92 -54), but the residue must retain one. 2. [Sec. 14- 302.B.7] Reservoir watershed/ag forest district. COMMENT: Provide note as required by this section. FYI- this property is not in an agricultural forestal or water supply watershed. 3. [Sec. 14 -309, 310] Soils work and health department approval. COMMENT: The subject parcel will be less than 5 acres as a result of this boundary line adjustment. Per the requirements of this section, please provide evidence of soils work/health department approval. Because there is an existing residence on this parcel, evidence of previous approval showing the primary and reserve drainfields will remain on the residue should suffice.
