SUB2010 -135 Foxchase Landing Final Plat- Lots 3, 4, and 11
The Zoning and Current Development Division of the Albemarle County Department of Community Development
will recommend approval of the proposed plat referred to above when the following items have been satisfactorily
addressed. (The following comments are those that have been identified at this time. Additional comments or
conditions may be added or eliminated bases upon further review.) Each comment is preceded by the applicable
reference to the Albemarle County Code.
1. [Sec. 14- 302.A.2] Vicinity map. COMMENT: Per this section, vicinity map must be at a scale of
1 "= 2000'.
2. [Sec. 14- 302.A.3, 435.1] Existing streets, surety for maintenance until accepted into state system.
COMMENT: Extension of Carlyle and new Riley Way have been built, however it does not appear they
have been accepted into the state system. Roads must be accepted by VDOT or bonded.
3. [Sec. 14- 302.A.9] Building sites. COMMENT: While you are only platting Lots 3, 4, and 11 as "lots" the
residuals will be considered platted parcels with frontage and therefore must contain a building site. Please
verify that each parcel contains a building site.
4. [Sec. 14- 302.B.6, 3031 Tax map and parcel number, boundary lines. COMMENT: Why is parcel
TMP56 -10OF included in this subdivision plat? I see it was also referenced on the preliminary plat, but
according to the callouts on the plat the property line of TMP 56 -93C follows the centerline of the stream
and it appears that the proposed open space dedication also follows the CL of meandering stream/ aka the
property line. Please clarify where the property line is compared to the centerline of the stream and the
proposed open space dedication ends. Also, please make sure TMP 56 -10OF is properly labeled on the plat.
5. [Sec. 14- 302.B.7] Ag forest /water supply protection area. COMMENT: Provide notes as required by this
section. FYI- this parcel is Not in an Agricultural Forestal District and is within a water supply protection
area/ Lickinghole Creek.
6. [Sec. 14 -401, 419] Lot 11 is a double frontage lot. Please provide a restricted access and landscaping
easement along its frontage with Carlyle Place, pursuant to these sections.
7. COMMENT: Approval and deeds /easement required by commenting departments, including Engineering,
VDOT, ACSA/RWSA, and Fire is required.
8. Condition of preliminary approval #1: A signed and dated conservation plan per Sec. 32.7.9 is required to
be submitted and approved.
9. Condition of preliminary approval #2: Submittal and approval of covenants or other such instrument which
evidences the establishment of an owners' association and provides for ownership and maintenance of
proposed open space. Such document is subject to County Attorney review and approval and shall be in
accordance with Sec. 14 -317- instrument evidencing maintenance of certain improvements.
