Subject: SDP2010 -00086 Lockwood Town Homes Final Prior to Preliminary Site Plan
The County of Albemarle Division of Zoning and Current Development will grant or recommend approval of
the final prior to preliminary site plan referred to above once the following comments have been addressed:
[Each comment is preceded by the applicable reference, which is to the Subdivision /Zoning Ordinances unless
otherwise specified.]
1. This proposal has been submitted as a final prior to a preliminary. The ordinance contemplates the
approval of a preliminary site plan prior to the submittal of a final site plan. However, by interpretation
the ordinance does allow the submittal of a final prior to approval of a preliminary. No mechanism
exists in the ordinance for the County to approve with conditions a final site plan. Therefore, if the site
plan does not have all necessary approvals to allow signature by the revision deadline the County will
deny your application. You may request that this project be changed from a final to a preliminary site
plan which may allow the County to approve the plan with conditions or you may request that the
County defer taking a formal action on your application.
2. Add the Site plan Number SDP2010 -00086 to the cover sheet for present and future reference.
3. If phasing is planned, phase lines and proposed timing of development: This development is in Block
C3. The code of development anticipates that the block would be 1.5 acres in size. The minimum
number of multifamily houses to be built on this block is 15 and the maximum is 30 (see page 14 table
D). The size of the linear park needs to be taken into consideration (Zoning needs to make a decision on
the sizing of the linear Park [41,600 square feet, Table E] which may be affected size wise). Density in
DU /Acre needs to take into account the acreage of the block and not the entire 7.36 acres shown.
4. 4.12.16.b Design of spaces. All parking spaces shall be designed so that no part of any vehicle will
extend over any lot line, right -of -way line, sidewalk, walkway, and driveway or aisle space. Some of the
units with onsite parking will not have enough space for a typical parking space i.e. 9 x 18. Please
revise. Additionally, clearly delineate units with garages on the site plan
5. ❑ (b) Interior landscaping: Exclusive of the requirements of section 32.7.9.7 (a) and (c), an area
equal to five (5) percent of the paved parking and vehicular circulation area shall be landscaped
with trees or shrubs. ❑ (b) This shall include one (1) large or medium shade tree per ten (10)
parking spaces or portion thereof, if five (5) spaces or more. Please include interior landscaping
calculations in the landscape plan and delineate medium shade trees that are part of the interior
landscaping.
6. 32.7.9.9 Tree canopy requirements are as follows
b. The following minimum requirements shall apply:
01. Ten (10) percent tree canopy for a site to be developed with commercial, office or industrial
uses;
02. Ten (10) percent tree canopy for a residential site to be developed at a gross density of twenty
(20) dwelling units per acre or more;
❑3. Fifteen (15) percent tree canopy for a residential site to be developed at a gross density of
more than ten (10) but less than twenty (20) dwelling units per acre;
04. Twenty (20) percent tree canopy for a residential site to be developed at a gross density of ten
(10) or fewer dwelling units per acre.
Based on the gross density 31/7.36 =4.21 the required amount of canopy is Twenty (20) percent
tree canopy for a residential site to be developed at a gross density of ten (10) or fewer dwelling
units per acre. A 10 percent tree canopy has been used to determine the required canopy.
PROFFERS: The following proffers need to be satisfied before final site plan approval is granted. Please
refer to the signed proffer document for a detailed description of the proffers.
Proffer #2 Road Improvements: needs to be satisfied before final site plan approval can be granted.
Proffer #3 Public Transit Stop Construction: Two public transit stops within this Area A2 need to be
constructed. Please locate two public transit stops with this site plan.
Proffer #5 Greenway: Powel Creek Greenway (7.6) acres need to be dedicated to Albemarle County.
Proffer #11 Phasing Plan: building permits for at least 100 dwelling units need to have been issued prior to
issuance of a building permit that would authorize the construction of any square feet of gross floor area
(aggregate) of commercial and office gross floor area within the property.
