This proposal has been submitted as a final prior to a preliminary. The ordinance contemplates the approval of a preliminary site plan prior to the submittal of a final site plan. However, by interpretation the ordinance does allow the submittal of a final prior to approval of a preliminary. No mechanism exists in the ordinance for the County to approve with conditions a final site plan. Therefore, if the site plan does not have all necessary approvals to allow signature by the revision deadline the County will deny your application. You may request that this project be changed from a final to a preliminary site plan which may allow the County to approve the plan with conditions or you may request that the County defer taking a formal action on your application. 2. Add the Site plan Number SDP2010 -00087 to the cover sheet for present and future reference. 3. [32.5.6.b] Add the proposed uses and maximum acreage occupied by each use to the General notes on the cover sheet. The uses are specified, but the maximum square footage (s) of the uses is not listed. 4. [32.5.6.b] [4.12.8.e] Schedule of parking including maximum amount required and amount provided. Please provide a narrative that illustrates the shared parking arrangement. This narrative should be addressed to the Zoning Administrator. This narrative will supplement the shared parking study included on the site plan. Movie Industry parking requirements and standards need to be taken into account. All businesses involved in the shared parking may need to sign a shared parking agreement. Recordable documents detailing shared parking will be required. [4.12.8.e] Instrument assuring continuation of off -site parking. If stand -alone parking or off -site shared parking is to be provided, the applicant shall submit with the application for a site plan, site plan waiver or, if a site plan is not required, with an application for a zoning compliance clearance, an instrument that restricts the use of that part of the land on which parking is provided to that use, and assures that a minimum number of parking spaces as required by this section shall be established and maintained for the life of the use. The instrument shall be in a form that is suitable for recording, shall be subject to review and approval as to form and substance by the county attorney, and shall be recorded in the office of the clerk of the circuit court of the county before the site plan or site plan waiver is approved. As the parking requirements for the use or structure change, subsequent instruments may be submitted, reviewed, approved and recorded that rescind or modify the prior instrument. 5. The site plan does not match the approved application plan (ZMA 2010 -6). Proposed residential buildings that appear on the application plan are missing. 6. [32.5.6.c] If phasing is planned, phase lines and proposed timing and development: The phasing line on the site plan is not very clear. Please boldly delineate the proposed phasing line on sheet 3 (site plan). 7. [32.5.61] Add a signature panel on the cover sheet: for the various divisions in community development and relevant outside agencies. 8. [4.17] Lumen levels of 3000 or more must be full cutoff. The cut sheets on sheet 29 are illegible. Please provide legible cut sheets that show that the proposed fixtures are full cutoff. 9. [4.17]Maintenance factor or Light Loss Factor needs to be 1. 10. Indicate the number of street trees provided per linear feet of frontage (public streets) PROFFERS: The following proffers need to be satisfied before final site plan approval is granted. Please refer to the signed proffer document for a detailed description of the proffers (attached). Proffer #2 Road Improvements: needs to be satisfied before final site plan approval can be granted. Proffer #3 Public Transit Stop Construction: Two public transit stops within this Area A2 need to be constructed. Please locate two public transit stops with this site plan. Proffer #5 Greenway: Powel Creek Greenway (7.6) acres need to be dedicated to Albemarle County. Proffer #6 Pocket Park: The owner needs to establish approximately 10,000 square feet pocket parks as shown on the General Development Plan. Proffer #11 Phasing Plan: building permits for at least 100 dwelling units need to have been issued prior to issuance of a building permit that would authorize the construction of any square feet of gross floor area (aggregate) of commercial and office gross floor area within the property.
