Thank you for the recent submittal for this special use permit application. Please find review
comments included in this letter.
Please see the attached resubmittal schedule for a list of dates on which you can submit your
revisions and responses to review comments (below and attached), as well as for possible
Planning Commission dates (please note that the listed dates are the earliest possible, but actual
dates need to be selected to suit the revision schedule for each project.)
COMMENTS
Planning (Scott Clark)
Comprehensive Plan — the Albemarle County Comprehensive Plan does not encourage
residential development in the Rural Areas. The plan calls for supporting the needs of
rural residents without increasing development in the Rural Areas, and for directing
residential development into the Development Areas. Planning review of this application
will be based in these Comprehensive Plan policies.
However, requests for additional development rights have sometimes been approved,
usually when all of the allocated rights were used for family members and the family
wants to transfer more land to a family member. Requests for other reasons have
generally not been approved.
In this case, there is one development right remaining from the original property. That
right is allocated to Tax Map 34 Parcel 74D, which is adjacent to your property. Have
you worked with the owner of that parcel to arrange to transfer the existing right? Could
you secure a development right from that or any other parcel rather than using an
additional right?
Was the property transferred to you by a family member, or sold to you by an unrelated
previous property owner?

Current Development — Planning (Bill Fritz)
The location of the existing dwelling in the center of the property will make it difficult to
provide the required two acre parcel with an adequate building site. The applicant should
be put on notice that a subdivision plat will still have to be submitted and the issuance of
a special use permit does not waive or modify any of the requirements for a subdivision
contained in either the Subdivision or Zoning Ordinances.
Inspections (Jay Schlothauer)
• No objection.
Fire /Rescue (James Barber
• No objection. Must comply with the Virginia Statewide Fire Prevention Code.
Virginia Doartment of Health (Josh Kirtley)
• Department of Health comments will be provided as soon as they are available.
Virginia Department of Transportation Joel Denunzio)
• VDOT has scheduled a time to check the sight distance along route 640 at the
intersection for Braxton Road and will send a follow up evaluation of the findings.
