We would be glad to meet with you to discuss these issues. Our comments are consolidated below: Planning Initial comments on how your proposal generally relates to the Comprehensive Plan are provided below. Comments on conformity with the Comprehensive Plan are provided to the Planning Commission and Board of Supervisors as part of the staff report. 1. The plan submitted with the application will require additional information. For examples of other similar applications please see SP2008 -58 Harris Auto and SP 2008 -25 Earlysville Auto in the Community Development Department. You may wish to call ahead (434/296 -5832) to have the files ready for your arrival. You may also wish to ask for an appointment with me to discuss the contents of these files at the same time. I can be reached at 434/29605832 extension 3249. 2. The property is located within the Rural Areas land use designation of the Comprehensive Plan. While the Rural Areas section of the Comprehensive Plan does not specifically mention public garages, it does caution that the size and intensity of rural alternative uses should be limited so that they do not conflict with the character of the Rural Areas. A Guiding Principle aims to address the needs of existing rural residents without fostering growth and further suburbanization of the Rural Areas. Attention to this application will be given to traffic, noise, and retention of the character of the rural area. More detailed comments may be provided at a later date after more detailed plans are provided. Zoning The following comments related to zoning matters have been provided by Amelia McCulley: 1. Depending on how many vehicles will need parking spaces outside the garage as they await repair or pickup, the existing paved driveway area may not accommodate all necessary parking. By my rough calculations, there is sufficient room for the five (5) spaces required (two for the dwelling and one for each service bay). However, this number does not include any parking for vehicles awaiting repair. Please ask the applicant to explain how he is going to handle parking for vehicles that are either awaiting repair or have repair completed and are awaiting pickup. 2. We will need a sketch plan that depicts the entrance and the area for vehicles awaiting repair (if applicable) as well as available parking area. The plan should also show any outdoor storage or features if proposed, such as oil barrels, outdoor vehicle lifts, storage or parts and the like. With this type of use, we typically impose a condition to limit the area and/or number of vehicles awaiting repair. Once we have the information request in #1 and #2, we will do an onsite visit to see how it can work. 3. It will be good to ask the applicant to address issues such as: a) is he proposing a paint booth? b) how will he handle storage and disposal of fluids such as oil and the like? Current Development The following comments have been provided related to how your proposal may or may not be able to meet site plan or subdivision ordinance requirements in the future by Bill Fritz: 1. It is likely that a site plan will be required for this use. A site plan will be required if a change in the entrance is required or recommended by VDOT or if the Zoning Administrator determines that additional parking is required. The applicant proposes to have 3 vehicles parked outside. Along with the 2 spaces required for the residence this would require a minimum of 5 parking spaces. From the information submitted I cannot determine the number of available parking spaces. If a site plan is required substantial improvements will be required to the site unless waivers are granted. For example, the access to the public street may have to be upgraded. You may want to consider improvement of this access even if a site plan is not required. 2. It appears that most of the activity proposed is within a stream buffer. If improvements have to be made to the site the presence of the stream buffer may impose additional regulations. Engineering and Water Resources The following comments related to engineering and water resources have been provided by Glenn Brooks: This use should have a plan, with parking, a commercial entrance, and other requirements per Zoning Ordinance 18 -32. Similar uses in Earlysville could be used as comparison. Fire and Rescue: The following comments have been provided by James Barber: Must obtain required permit(s) for chemical storage and use. Must comply with the Statewide Fire Prevention Code. Final approval is subject to field inspection and verification. VDOT Comments from VDOT were submitted by Joel DeNunzio and are attached. Resubmittal or Public Hearing Within 30 days of the date of this letter, please do one of the following: (1) Resubmit in response to these comments on a resubmittal date as published in the project review schedule (the full resubmittal schedule may be found at www.albemarle.org in the "forms" section at the Community Development page), OR (2) Request a public hearing be set with the Planning Commission based on the information provided with your original submittal (a date will be set in accordance with the Planning Commission's published schedule as mutually agreed to by you and the County), OR (3) Request indefinite deferral and state your justification for requesting the deferral. (Indefinite deferral means that you intend to resubmit /request a public hearing be set with the Planning Commission after the 30 day period.) N If we have not received a response from you within 30 days, we will contact you again. At that time, you will be given 10 days to do one of the following: a) request withdrawal of your application, b) request deferral of your application to a specific Planning Commission date as mutually agreed to with staff, or c) request indefinite deferral and state your justification for requesting the deferral. If none of these actions is taken, staff will schedule your application for a public hearing based on the information provided with your original submittal. Unless you fail to respond within the time periods specified above, a public hearing with the Planning Commission will not be advertised until you advise us that the project is ready to proceed to a public hearing. At that time, a legal advertisement will be run in the newspaper and a staff report will be prepared to go to the Planning Commission. Please be advised that, once a public hearing has been advertised, only one deferral prior to the Planning Commission's public hearing will be allowed during the life of the application. The only exception to this rule will be extraordinary circumstances, such as a major change in the project proposal by the applicant or more issues identified by staff that have not previously been brought to the applicant's attention. As always, an applicant may request deferral at the Planning Commission meeting. Please feel free to contact me if you wish to meet or need additional information.
