County of Albemarle Department of Community Development Memorandum To: Judith Weigand, Senior Planner From: Amelia McCulley, Zoning Administrator Division: Zoning Date: December 22, 2010 Subject: ZMA 2010 -013 HTC A2 I have reviewed the initial submittal and have the following comments: Proffer #11 Phasing Requirement of 30 Residential Building Permits — There is a conflict in the submittal because narrative attached to the application refers to 31 residential permits and the proffer states 30. Because the site plan for these units is showing that the linear park is being compromised, Zoning recommends a lower number of units, such as 28. The linear park is another rezoning requirement and it may be considered a major element that may not be varied. Especially with the proposed reduction in the pocket park size, we suggest that this linear park area be preserved. Please add to the wording (see bold underlined) "prior to issuance of building permits that would authorize ..." 2. Proffer #6 Pocket Park Reduction — Based on Planning staff research, a 20% amenity area shall be provided within HTC A2. The Code shows 14,500 square feet of pocket park area within this area. Therefore, the applicant must show where the area proposed for reduction is provided elsewhere. In addition, it must be provided in such a location and size that it is consistent with the intended purposes of the amenity areas. The applicant should address this and provide a chart showing proposed amenity areas and the resulting percentage provided. If the pocket park amenity area is not provided within the same block, the applicant will need to request a variation to the Code. Those amended pages should also be provided. 3. The proffers for HTC A2 should be amended to include the proffer from HTC Al regarding construction and dedication of Meeting Street that is south of Powell's Creek. Please consult Mark or Glenn as to the timing which may have two prongs, whichever comes first: building permits for buildings south of Powell's Creel or the County's request. 4. Proffer #3 Public Transit Stop Construction — it is my understanding that the location of these transit stops has not been tied down and shown on road or site plans. Please ask the applicant to tie this down in terms of location. Otherwise, it will be difficult to know with which plans they must be phased. 5. Proffer #5 Greenway — the 7.6 acre "greenway" is supposed to be improved and dedicated with the first site plan. Please ask the applicant to comment on the status of this proffer.
