Dear Herb:
County staff received the variation request referenced above to modify several street sections to meet
VDOT clear zone requirements. The letter requesting the variation is Attachment A.
I shared the letter and attachments with Philip Custer, Glenn Brooks, and Joel DeNunzio to better
understand the request.. These three reviewers advised me that the request is premature since Philip
has not completed his review of the road plans. There may be recommended or required changes
that affect your variation request. For that reason, I can't tell if the variation request is in general
accord with the purpose and intent of the approved rezoning application.
After Philip and Joel have completed their review, they will advise us of any needed changes that may
affect the roads. Once you see their comments, it willbe clearer if and where any variations are
needed.
When you resubmit your variation request, please be sure to use the application which you can find
on -line at this location:

Dear Ms. Echols:
This variation is requested to comply with the VDOT requirement to provide a 10 foot clear zone
from the edge of the travelway to the center of the street tree. The roadway cross - section NWP 1,
NWP 2, NPBS and NPB EP as depicted on sheets D1 and D2 of the Application Plan associated
with the above referenced ZMA do not accommodate this requirement. The street sections
presented on sheet of 10 of 30 of the North Pointe Phase III Road Improvements Plan (WPO-
2010- 00074) have been modified to meet this VDOT clear zone requirement. Sheets
10, 12, and 13 of 30 of this plan are enclosed for your use.
I have enclosed sheet D1 and D2 of the Application Plan associated with the rezoning documents
for your use. These sheets contain a latest revised date of June 13, 2006. These sheets contain the
Northwest Passage and North Pointe Boulevard cross - sections referenced. Please be advised that
the road named Northwest Passage has been changed to Lewis and Clark Drive.
We trust that you will find that the revised roadway cross - sections as proposed with the
submission of WPO- 2010 -00074 are in conformance with that shown on the rezoning documents
and that this variation may be approved.
