Subject: SUB - 2010 -131- James Property- Family Division
The Planner for the Zoning & Current Development Division of the Albemarle County
Department Community Development will recommend approve the plan referred to above when
the following items have been satisfactorily addressed. (The following comments are those that
have been identified at this time. Additional comments or conditions may be added or eliminated
based on further review.) [Each comment is preceded by the applicable reference to the
Albemarle County Code.]
1. [ 14 -302 (A)(9)] Building sites on proposed lots. The building site shown does not meet
the requirement in Section 4.2 of the Zoning Ordinance. Revise to show a building site
location that is thirty- thousand square feet and of such dimensions that no one dimension
exceeds any other by a ratio of more than five (5) to (1) as described by a rectangle
inscribed within the building site. Also, provide the following note on the plat: "Parcel
[letter or number] and the residue of Tax Map /Parcel [numbers] each contain a building
site that complies with section 4.2.1 of the Albemarle County Zoning Oridinance."

2. [ 14 -303 (S)] Control points. Provide at least four (4) control points, evenly distributed
across the property and located at survey property corners, and shown on each sheet
depicting the property. At the option of the subdivider, the control points may be shown
on a copy of the final plat, rather than on the original final plat.

3. [14 -211 and 14 -212 (A)] Verification of Family Division. Provide a copy of an affidavit,
deed, or letter from attorney stating: grantee, grantor and their relationship; and certifying
that this is a Family Division in accordance with Section 14 -208 and related provisions of
the Albemarle County Code. A template is attached.

4. [14 -212 (B)] Family subdivisions; conditions of approval. The subdivider shall place a
restrictive covenant on the lots created by the family subdivision prohibiting the transfer
of the lots so created to a person who is not a member of the immediate family for the
retention period after the date of recordation. A template for this covenant is attached.

5. [14 -212 (C); 14 -316] Approval of entrance on public streets. VDOT approval is required.
Provide a statement from VDOT granting their approval.
Revl: Please have the reviewer at VDOT email me the approval for our records.
6. [14- 308.1] Groundwater assessment information. Please provide the proper fee so that a
groundwater assessment can be done. See the front desk in Community Development to
determine the fee amount.
Revl: Comment addressed.
[ 14 -309; 14 -310] Soil evaluations; Health Director approval of wells and /or septic
systems. Provide three copies of the results of percolation tests or other methods of soil
evaluation used to determine the suitability of the soil for septic systems with
conventional drain fields for review and approval by the Health Department.
Revl: Waiting for the soils report to be submitted so that it can be forwarded to the
Health Department for review and approval.
[ 14 -412] Standards for private streets only. Provide the following note on the plat: "The
existing and/or proposed right -of -way is of adequate width and horizontal and vertical
alignment to accommodate a travelway passable by ordinary passenger vehicles in all but
temporary extreme weather conditions, together with area adequate for maintenance of
the travelway, as required by section 14 -412 of the Albemarle County Code."
Revl: Comment not addressed. This note must be on the plat, stated verbatim.
