The County of Albemarle Division of Current Development will grant or recommend approval of the Family
Division plat referenced above once the following comments have been addressed: [Each comment is preceded
by the applicable reference, which is to the Subdivision/Zoning Ordinances unless otherwise specified.]
1. [14- 302.B.1] General information: The date of drawing, including the date of the last revision, the number
of sheets, the north point, and the scale. If true north is used, the method of determination shall be shown.
Please add to the plat [Page 1 of 11 to ascertain that this is page 1 of 1 of the plat.
2. [14- 303.Q] Water supply. A statement as to whether the subdivision will be served by a public water supply
and a public sewer system. If the property is not within the service authority jurisdictional area, the
following statement: "Under current county policy, public water and/or sewer service will not be available
to this property." Add the note "under current county policy, public water and /or sewer service will not
be available to this property" to the plat.
3. [14- 303.S] Control points. At least four (4) control points, evenly distributed across the property and
located at survey property corners, and shown on each sheet depicting the property. At the option of the
subdivider, the control points may be shown on a copy of the final plat, rather than on the original final plat.
Add control points to the plat, or provide a separate copy of the plat with control points as indicated
above.
4. [Sec. 14 -211 and Sec. 212 (A)] - Verification of Family Division. Copy of affidavit, deed, letter from
attorney stating: grantee, grantor and their relationship; and certifying that this is a Family Division in
accordance with Section 14 -208 and related provisions of the Albemarle County Code. Please provide a
copy of an affidavit, deed or letter from an attorney confirming the grantor and grantees relationship
and certifying that this is family division per the Albemarle County Code.
5. [14- 412(B)] Plat note: "No lot shown on this family subdivision plat may be sold or conveyed to a person
other than an eligible `member of the immediate family,' as that term is defined in Chapter 14 of the
Albemarle County Code, for a period of fifteen (15) years from the date of recordation of this plat except
as authorized by Section 14- 212(A) of the Albemarle County Code. If any lot created by the recordation of
this plat is conveyed back to the grantor during the fifteen (15) year period, it shall be recombined with the
parent lot within six (6) months after such conveyance." Change the note on the plat to read as shown.
The Board of Supervisors on October 13, 2010 approved a request for an additional development
right with a condition that the family division period to retain the property be extended to fifteen (15)
years.
6. [Sec. 14- 212(C) & 14 -316] The entrance of the principal means of access for each lot onto any public street
shall comply with Virginia Department of Transportation standards and be approved by the Virginia
Department of Transportation. Please provide evidence of VDOT approval of the entrance off Craig's
Store Road (SR 635).
7. [Sec. 14 -309 and Sec. 14 -310] Soil evaluations (if any lot is less than 5 acres) and Health Director approval
of wells and/or septic systems is required. Submit soils work that will be sent to the Health Director for
approval
8. [Sec. 14- 235(B)] plat note: Statement in 14- 303(N). "The streets in this subdivision may not meet the
standards for acceptance into the secondary system of state highways and will not be maintained by
the Virginia Department of Transportation or the County of Albemarle." Add this note to the plat.
9. The applicant needs to fill out and sign a Declaration of Family Division. I have attached the
declaration of family division.
