The County of Albemarle Division of Zoning and Current Development will grant or recommend
approval of the subdivision plat referred to above once the following comments have been addressed:
[Each comment is preceded by the applicable reference, which is to the Subdivision /Zoning
Ordinances unless otherwise specified.]
1. [14- 302(B)101 Stream buffers. The location of stream buffers required by section 17 -317 of the water
protection ordinance, with the following note: "The stream buffer(s) shown hereon shall be managed in
accordance with the Albemarle County Water Protection Ordinance." Please show the stream buffer
location on the plat. The note is on the plat but I cannot locate the buffer. Refer to the Albemarle
County GIS web for guidance.
2. [14- 233.B.I] The shown new 30 foot access easement should be changed to "New 30 foot Private
Street ". The agent can only approve the subdivision with a private street. The approved private street
will provide frontage to the Pantops fire Station lot. Private streets serving non - residential uses can be
approved administratively by the agent.
Each private street authorized to serve non - residential, non - agricultural, attached residential, multi-
unit residential and combined residential and nonresidential uses under sections 14 -232 or 14 -233 shall
satisfy Virginia Department of Transportation standards or an alternative standard deemed adequate by
the agent, upon the recommendation of the county engineer, to be equivalent to or greater than the
applicable standard in the design standards manual, so as to adequately protect the public health,
safety or welfare. The agent may require minimum travelway widths to provide for on- street parking
upon a determination that the provisions for off - street parking may be inadequate to reasonably
preclude unauthorized on- street parking. Refer to engineering comments for acceptable standards
for the new 30 foot private street.
3. [14 -317] Instrument evidencing maintenance of certain improvements. The subdivider shall submit
with the final plat an instrument assuring the perpetual maintenance of the improvement. Please submit
a maintenance agreement that will assure the perpetual maintenance of the new 30 foot private street. A
private street maintenance agreement template is available for use if you would like to use the county
prepared agreement.
4. All drainage easements dedicated to public use must be accompanied by a deed of dedication.
