Lono — VWUianne &4u||sm 321 East Mein Btneet# 400 Charlottesville, VA, 228O2, RE: SP 2011-00004, Eagleburger Property AT&T CV 352 Tier III PWSF Tax Map 58 Parcel 66 Dear Valerie, Fax N34\972-4012 Thank you for your recent Special Use Permit submittal for a proposed one hundred and fifty five (155) foot seven (7) inches tall tower with six flush mounted antennas within an existing non- conforming electric power tower and associated ground equipment. The information provided with your initial application for a Special Use Permit has been reviewed by the Department of Community Development, including the Planning Division, the Zoning Division and Current Development Division, The Rivanna Water and Sewer Authority has also reviewed the project. Comments are expected from the Virginia Dept. of Transportation, and will be forwarded as soon @s they are received. Comments from reviewers are summarized below. Current Deyplopment The Planner for the Current Development Division of the Albemarle County Department of Community Development will recommend approval of the plan referred to above when the following items have been satisfactorily addressed. (The following comments are those that have been identified ot this time. Additional comments or conditions may be added oreliminated based on further revievv.) [Each comment iS preceded bv the applicable reference tothe Albemarle County Cnde.] 1. The zoning of the property is (RA) Rural Areas and not R-1 Residential as shown on the cover sheet. 2. The proposed tower height is 155 feet seven (7) inches. The Electric Power tower height is 140 feet seven /7l inches. Please revise the project data on the cover sheet. 3. The jurisdiction of the property is Albemarle County as indicated on the cover sheet. This information needs to be consistent with that on sheet SP-1 under site notes. The Magisterial District is Samuel Miller. 4. Page 27 of A|bern@r|a County's Personal Wireless Service Facilities Policy states that "opportunity sites include those locations where existing structures provide siting forpersonal wireless facilities. The placement, construction ancl»rrnodificmti0n of personal wireless facilities within an Opportunity Site /sencouraged" Electric transmission towers are atype of opportunity site. While the electric power transmission tower inthis application represents SP 2011 -4 Eagleburger Property AT &T CV352, Valerie Long, April 8, 2011 the use of an opportunity site, staff has to determine whether the resulting design has visibility impacts that can be reduced or eliminated using alternative types of equipment and mounting techniques. Staff will evaluate this site and make a recommendation based on the visual impact. The most important principal for siting personal wireless service facilities in Albemarle County is visibility_ 5.1.40.(d)2 requires that the site provide adequate opportunities for screening and the facility shall be sited to minimize its visibility from adjacent parcels and streets regardless of their distance from the facility. 5. Modifications will have to be granted by the Board of Supervisors for sections 5.1.40.(C).4, 5.1.40.(C).5, and 5.1.40(d)6. Rivanna Water and Sewer Comments (RWSA): Rivanna Water and Sewer comments are attached. Albemarle County Fire and Rescue: Albemarle County Fire and Rescue comment is enclosed. Albemarle County Division of Inspections: Building Official has no comment. Resubmittal or Public Wearing Within 30 days of the date of this letter, please do one of the following: (1) Resubmit in response to these comments on a resubmittal date as published in the project review schedule (the full resubmittal schedule may be found at v.albemarle.or in the "forms" section at the Community Development page, (2) Request a public hearing be set with the Planning Commission based on the information provided with your original submittal (a date will be set in accordance with the Planning Commission's published schedule as mutually agreed to by you and the County), or (3) Request indefinite deferral and state your justification for requesting the deferral. (Indefinite deferral means that you intend to resubmit /request a public hearing be set with the Planning Commission after the 30 day period.) If we have not received a response from you within 30 days, we will contact you again. At that time, you will be given 10 days to do one of the following: a) request withdrawal of your application, b) request deferral of your application to a specific Planning Commission date as mutually agreed to with staff, or c) request indefinite deferral and state your justification for requesting the deferral. If none of these actions is taken, staff will schedule your application for a public hearing based on the information provided with your original submittal. Unless you fail to respond within the time periods specified above, a public hearing with the Planning Commission will not be advertised until you advise us that the project is ready to proceed to a public hearing. At that time, a legal advertisement will be run in the newspaper and a staff report will be prepared to go to the Planning Commission.
