Dear Mr. Rhett,
Staff has reviewed your resubmittal for these special use permits. We have a few questions and comments
which are indicated below:
Planning
Zonin
Please submit a revised conceptual plan reflecting the reviewers' comments. This plan should
show the entire area involved in this use.
Please note that amplified music /sound outside the barn will increase the probability of nuisance
noise effects on neighbors. The use will be subject to the noise requirements of the Zoning
Ordinance. The fact that outdoor amplification is planned is another reason for our
recommendation of limited hours of operation (see Zoning comments).
What would be the minimum event size for ticket checks at the entrance gate? How would the
ticket check be managed to prevent traffic backing up onto the public road?
I will refrain from commenting on individual design elements until the other reviewers'
comments are addressed in the next revision.
Before this application goes to its first public hearing, we will need to have a letter from The
Nature Conservancy stating that the proposal as it stands at that point would be in compliance
with the conservation easement.

Engineering and Water Resources (Glenn Brooks)
I have received the response letter, and have no changes to my previous comments. Mr. Thacker's
letter regarding the farm pond was an agricultural exemption from the WPO. Zoning and FEMA
regulations still apply, and an SP is needed for the dam and stream crossing.
VDOT (Joel Denunzio)
Current comments from VDOT will be supplied as soon as they are available. These are the original
comments:
1. There is inadequate sight distance to the right from the egress of the entrance to Route 640. The
trees across the road block sight distance and need to be removed and a sight distance easement will
need to be platted for the sight lines.
2. The entrance width and throat do not meet the minimum standards. This entrance should at a
minimum meet the standard for a private road entrance which would be 24 feet paved with 25 foot
radii and an entrance throat length of 30 feet. The brick columns on either side of the entrance
should be relocated to add additional width to reduce the chance of occurrence of traffic queuing on
Route 640 when events have continuous ingress and egress traffic conflicting with one another.
Resubmittal or Public Hearing
Within 30 days of the date of this letter, please do one of the following:
(1) Resubmit in response to these comments on a resubmittal date as published in the project review
schedule (the full resubmittal schedule may be found at www.albemarle.org in the "forms"
section at the Community Development page). Please use the enclosed resubmittal form; OR
(2) Request a public hearing be set with the Planning Commission based on the information
provided with your previous submittal (a date will be set in accordance with the Planning
Commission's published schedule as mutually agreed to by you and the County), OR
(3) Request indefinite deferral and state your justification for requesting the deferral. (Indefinite
deferral means that you intend to resubmit /request a public hearing be set with the Planning
Commission after the 30 day period.)
If we have not received a response from you within 30 days, we will contact you again. At that time, you
will be given 10 days to do one of the following: a) request withdrawal of your application, b) request
deferral of your application to a specific Planning Commission date as mutually agreed to with staff, or c)
request indefinite deferral and state your justification for requesting the deferral. If none of these actions is
taken, staff will schedule your application for a public hearing based on the information provided with your
original submittal.
Please be advised that, once a public hearing has been advertised, only one deferral prior to the Planning
Commission's public hearing will be allowed during the life of the application. The only exception to this
rule will be extraordinary circumstances, such as a major change in the project proposal by the applicant or
more issues identified by staff that have not previously been brought to the applicant's attention. As always,
an applicant may request deferral at the Planning Commission meeting.
