Subject: SUB - 2011 -024- Heiner, Bertie- Boundary Line Adjustment
The Planner for the Zoning & Current Development Division of the Albemarle County
Department Community Development will recommend approve the plan referred to above when
the following items have been satisfactorily addressed. (The following comments are those that
have been identified at this time. Additional comments or conditions may be added or eliminated
based on further review.) [Each comment is preceded by the applicable reference to the
Albemarle County Code.]
1. [14 -302 (A)] Private easements. Is there an access easement for the driveway that
crosses TMP 59 -24B into TMP 59 -22? If so, please provide the deed book and
page number for that easement.
2. [14 -302 (B)] Reservoir watershed. The water supply watershed that this property
is located is Ivy Creek. Please revise the note to include the name Ivy Creek
Water Supply Watershed.
3. [14 -400] Minimum lot requirements. Show the required setbacks on the plan for
the adjacent structures. The side yard setback for this zoning district is 25 feet for
all structures. If the structures are accessory structures, as definite in the zoning
ordinance in the zoning ordinance as follows: "Accessory Use, Building or
Structure: A subordinate use, building or structure customarily incidental to and
located upon the same lot occupied by the primary use, building, or structure, and
located upon land zoned to allow the primary use, building or structure; provided
that a subordinate use, building or structure customarily incidental to a primary
farm use, building or structure need not be located upon the same lot occupied by
the primary farm use, building, or structure. (Amended 10 -9 -02, 5-5-10) "
If the structures are "accessory structures" then the setback is 6 feet. Show the
distances from the existing structures to the proposed lot line.
