We have a few questions and comments which are indicated below: Planning Some of the documents attached to this revision (e.g., the replanting plan) show only the impacts of the 30 -foot rise. However, as you are requesting the full 42 -foot increase, we will need to either (1) have equivalent documents for the 42 -foot rise to be referred to in the conditions of approval, or (2) have conditions of approval that require submission and approval of documents for the 42 -foot rise before work on the higher dam can commence. Zoning The following comments related to zoning matters have been provided by Amelia McCulley: Prior comments have been satisfied. The authorization letter from the adjoining owner is satisfactory Current Development No comments Engineering and Water Resources Please see the attached memo from Glenn Brooks. VDOT The following comments from VDOT have been provided by Joel Denunzio: 1. VDOT will need to ensure that the FHWA has approved any embankment changes to I-64 prior to issuing and Land Use Permits. It is my understanding that the applicant is working towards resolution with the FHWA and VDOT at this time. 2. For safe construction access and the safety of the existing users the final plan will need to be reviewed and approved by VDOT prior to issuing any Land Use Permits for construction entrances for the project. The following items need to be addressed in the final plan as the applicant has stated in their response letter: a. A plan of improvements to Reservoir Road to safely transport construction vehicles to the site. This plan may include paved or gravel pull off areas at certain intervals and or widening of Reservoir Road at key locations that may be safety issues such as tight curves or vertical alignment sight problems. b. A maintenance of traffic plan that includes flaggers and a communication plan with existing residents of the road. This plan will also address any time of day restrictions including the daily peak hour restriction and weekend or holiday restrictions. The plan needs to give VDOT the authority to monitor the contractor and make adjustments when needed due to conflicts and unforeseen circumstances. A person certified in maintenance of traffic will be required on site at any time there are activities on Reservoir Road that will restrict normal traffic operations. c. A maintenance plan and inspection process for maintenance needs to be included in the plan for minor grading, stone replacement, asphalt repair, shoulder repair, culvert repair and any other items that will degrade the road above normal expected use. VDOT needs to be involved with the regular inspection of the degradation of the road and have the ability to require maintenance when needed due to construction vehicles damaging the road. d. The road will need to be left in acceptable condition after construction and I recommend that any improvements made during the construction process including pull outs, paving or widening of the road be left in place. The plan should include final grading and stone to the gravel sections of the road and repaving of the paved sections. There is a small section of gravel in between two paved sections and the second paved section terminates after the final signal family residence on the road. The road should be paved from Fontaine Ave to the last single family residence once the construction is complete. A VDOT inspection of the road should be required prior to releasing the contract. [Planning Staff Note: If this use does not require a site development plan, then these items will be recommended as conditions of approval for the special use permit.] Resubmittal or Public Hearing Within 30 days of the date of this letter, please do one of the following: (1) Resubmit in response to these comments on a resubmittal date as published in the project review schedule (the full resubmittal schedule may be found at www.albemarle.org in the "forms" section at the Community Development page), OR (2) Request a public hearing be set with the Planning Commission based on the information provided with your original submittal (a date will be set in accordance with the Planning Commission's published schedule as mutually agreed to by you and the County), OR (3) Request indefinite deferral and state your justification for requesting the deferral. (Indefinite deferral means that you intend to resubmit/request a public hearing be set with the Planning Commission after the 30 day period.) If we have not received a response from you within 30 days, we will contact you again. At that time, you will be given 10 days to do one of the following: a) request withdrawal of your application, b) request PA deferral of your application to a specific Planning Commission date as mutually agreed to with staff, or c) request indefinite deferral and state your justification for requesting the deferral. If none of these actions is taken, staff will schedule your application for a public hearing based on the information provided with your original submittal. Please be advised that, once a public hearing has been advertised, only one deferral prior to the Planning Commission's public hearing will be allowed during the life of the application. The only exception to this rule will be extraordinary circumstances, such as a major change in the project proposal by the applicant or more issues identified by staff that have not previously been brought to the applicant's attention. As always, an applicant may request deferral at the Planning Commission meeting. Please feel free to contact me if you wish to meet or need additional information.
