SUB - 2010 -035- Barnett Property- Family Division
The Planner for the Zoning & Current Development Division of the Albemarle County
Department Community Development will recommend approve the plan referred to above when
the following items have been satisfactorily addressed. (The following comments are those that
have been identified at this time. Additional comments or conditions may be added or eliminated
based on further review.) [Each comment is preceded by the applicable reference to the
Albemarle County Code.]
1. [14- 302(A)(10)] Right offurther division ofproposed lots. Provide a notation stating the
division rights assigned to each parcel. "Parcel Al is assigned one development right and
may not be further divided. The residue of Tax Map 40 Parcel lOB is retaining one
development right and cannot be further divided."
2. [14- 302(A)(7)] Reservoir watershed; agricultural forestal district. Indicate with a
notation whether or not the parcel is in a reservoir watershed or agricultural forestall
district. It is located in the Beaver Creek Reservoir Watershed, and is in the Sugar
Hollow agricultural- forestal district.
3. [14- 303(S)] Control points. Provide at least four (4) control points, evenly distributed
across the property and located at survey property corners, and shown on each sheet
depicting the property. At the option of the subdivider, the control points may be shown
on a copy of the final plat, rather than on the original final plat.
4. [ 14 -211 and 14 -212 (A)] Verification of Family Division. Provide a copy of an affidavit,
deed, or letter from attorney stating: grantee, grantor and their relationship; and certifying
that this is a Family Division in accordance with Section 14 -208 and related provisions of
the Albemarle County Code. A template is attached.
5. [14 -212 (B)] Family subdivisions; conditions of approval. The subdivider shall place a
restrictive covenant on the lots created by the family subdivision prohibiting the transfer
of the lots so created to a person who is not a member of the immediate family for the
retention period after the date of recordation. A template for this covenant is attached.
6. [14 -212 (C); 14 -316] Approval of entrance on public streets. VDOT approval is required.
Provide a statement from VDOT granting their approval.
7. [14 -309; 14 -310] Soil evaluations; Health Director approval of wells and /or septic
systems. Soil evaluations were received and given to the Health Department. We are still
waiting their approval.
