RE: SUB2011 -032 Morris- Boundary Line Adjustment
Mr. Blankenbaker:
Pursuant to Chapter 14 Section 212.2 of the Albemarle County Code, Subdivision Ordinance, the above
referenced subdivision plat has been denied. This action has been taken because the subdivision does not
meet Section 14 -400, Minimum Lot requirements, of the ordinance, and TMP 31 -24J is becoming a
nonconforming lot with this boundary line adjustment. Outlined below are all of the requirements of the
ordinance that are not being met:
1. [14 -400] Minimum lot requirements. This boundary line adjustment is taking away the required
frontage for TMP 31 -24J, creating a non - conforming lot.
2. [14 -302 (A)(9)] Building sites on proposed lots. Provide the location, area and dimensions of a
building site on each proposed lot complying with the requirements of section 4.2 of the Zoning
Ordinance. The plat shall also contain the following note: "Parcel [letter or number] and the
residue of Tax Map /Parcel [numbers] each contain a building site that complies with section 4.2.1
of the Albemarle County Zoning Ordinance."
3. [14 -302 (A)(10)] Right offurther division ofproposed lots. Provide information concerning the
development rights of the parcels. If no development rights are being transferred with this
boundary line adjustment, state the following: "No development rights are being affected with
this boundary line adjustment."
4. [14 -302 (13)(7)] Reservoir watershed; agricultural forestal district. Provide with a notation as to
whether or not the property lies within a reservoir watershed or agricultural - forestal district. It
does not lie within an agricultural- forestal district, but is in the South Fork Rivanna Reservoir
Watershed.
5. [ 14 -303 (0)] Signature panels. Remove the signature panel for the chairman of the Planning
Commission. This is not needed or required.
