The first revision to the Northwest Passage ROW dedication plat (SUB- 2010 - 00099 /SUB -2011-
00011), received 4 February 2011, has been reviewed. Engineering can recommend approval to
the plat after the following comments are addressed.
1. All drainage easements dedicated to public use must be accompanied with Deed of Easements.
For the latest deed of easement template, please contact the County Attorney's Office.
(Rev. 1) Comment remains unchanged.
2. At the time of the last road plan submittal, there was some question with regard to the road cross -
section for the majority of Lewis and Clark Drive. The cross - section that last received county and
VDOT review possessed a 69ft ROW with 12ft travel lanes, 3ft bike lanes, 2.5 gutter and curbs,
8.0 ft planting strips, 5ft sidewalks, and an 8ft median (FOC to FOC). The ROW for this cross -
section terminated at the edge of the sidewalk which could not be maintained by VDOT without an
additional lft of ROW on each side. Since the county will not maintain the sidewalk in the current
configuration, a revision needs to be made. The applicant had sent a revised cross section to the
county planner with a 7.5 planting strip and a 0.5ft strip between the outer edge of sidewalk and
the ROW line. If this is acceptable to VDOT, this is acceptable to county engineering review,
though the variation from Planning will need to be updated.
(Rev. 1) Comment has been addressed. VDOT, County Planning, and County Engineering
have all approved the latest road sections.
3. Please remove sheets 3 and 4 from the set since there will no longer be a Ift maintenance easement
behind the ROW line.
(Rev. 1) Comment has been addressed.
4. The road cross - section at the stream crossing was commented on by VDOT and must be modified.
The ROW width at this crossing may need to be altered to match the cross - section whenever it is
approved in the road plan set.
(Rev. 1) Comment 3 from VDOT's latest review states that the lane configuration at the stream
crossing has yet to be verified because they have not reviewed a traffic signal timing plan. The
ROW in this area maybe subject to revision depending on further reviews performed by VDOT.
5. VDOT Comment 2 delivered 08/24/2010 indicates that there is a horizontal curve issue with
Lewis and Clark Drive. The ROW dedicated on this plat must match the ROW shown in the road
plan once the horizontal alignment is approved by VDOT.

6. For maintenance purposes, VDOT requires at least 1Oft of ROW from the face of wall along the

northbound Route 29 turn lane. Please show this ROW dedication on this plat.
(Rev. 1) This dedication is being reviewed under SUB - 2011 - 00009.
7. Large public drainage easements are needed over the stream culvert. Because of its size, the
easement should be 20ft off the eastern and western edges of the structure. This width may need
to be reduced or expanded depending on input from VDOT. Alternatively, the ROW can be
extended to the toe of the slope if permitted by VDOT.

8. The ROW can only be dedicated when a bond is posted. The applicant has the option of changing
the dedication note to read "Reserved for Dedication to Public Use Upon Demand of the County"
or completing a road bond request form and posting the bond before the plat is signed.
Regardless, the bond must be posted prior to site plan approval unless the proffers are modified.

9. Additional ROW for the county constructed bus shelters will be required. The ROW line should
be placed Ift behind the graded bus shelter pads.
(Rev. 1) Comment has been addressed.
10. Temporary ROW for the turnaround area is necessary for the intermediate phase until the rest of
Lewis and Clark Drive is constructed. The ROW should be 5ft from the edge of pavement. This
ROW is to be vacated when the road is extended.
(Rev. 1) After making this comment in the first review, I have come across a more detailed code
section regarding temporary turnarounds in the Subdivision Ordinance. Please add the note
that appears in 14 -303.K in the vicinity of the temporary turnaround with the road names
modified accordingly.
11. It is my understanding the greenway on the east side of the property has been requested by the
county to be dedicated at this time. This dedication can occur on the current application or a
separate plat. Whenever the greenway is dedicated, a Public Access Easement from the Lewis and
Clark ROW to the Greenway is needed. The easement should allow for easy pedestrian and
vehicular access to the greenway.
(Rev. 1) Comment has not been addressed. The public access easement must include both
sidewalks along the travelway.
12. On sheet 9 of 12, please label the western easement as "Variable Width Drainage Easement,
Hereby Dedicated to Public Use ". Also, above "Underground Stormwater Management
Facilities ", please add "Privately Maintained ".
(Rev. 1) This comment was made when there was no aboveground aspect of SWM 11 and there
might have been some confusion between the deed of easement language for the drainage
easements and the Storm water facility maintenance agreement. All aspects of this facility will
be privately maintained. Please either mention the entire facility is to be privately maintained
or remove the reference to private maintenance (now that public drainage and private swm
easements have been clearly separated).
13. On sheet 10 of 12, the easement over the pipe from structure 46 to 45 must be dedicated to public
use and not part of the SWM easement.

14. On sheet 10 of 12, please label the northern easement and the easement required in the previous
comment as "Variable Width Drainage Easement, Hereby Dedicated to Public Use."

15. On sheet 10 of 12, please correct the Stormwater Management callout to include both above and
below ground facilities. This easement will have complicated maintenance responsibilities
because public and private properties will be using it. The applicant should begin preparing the
stormwater management facilities maintenance agreement(s) for this project and so that any
pertinent language can be included on this plat if necessary. The County Attorney's office would
need to thoroughly review any modifications to the standard agreement which undoubtedly has to

be undertaken with SWM facility 10.
(Rev. 1) The stormwater facility maintenance agreement was recorded without any modification
regarding the maintenance responsibilities of the property owner and the county, which will
eventually own land draining to SWM 10. With this in mind, it has been determined, after
consultation with the County Attorney's office, that the maintenance arrangement will be
decided at the time of the school's development. Please either state that the entire facility is to
be privately maintained or remove the reference to private maintenance.
Also, please add the following note within the SWM easement on Sheet 9:
In accordance with Proffer 9.1 of ZMA- 2000 - 00009, the owner will grant the County of
Albemarle all easements necessary to allow Stormwater Basin 10 to be redesigned and
enlarged, if deemed necessary by county officials at the time of the School Lot's
development, to accommodate the School Lot stormwater.
16. Due to uncertainty with site and road plans, this plat should not be approved until the site plan is
nearly approved. Additional comments may be necessary as the site, road, and swm plans are
refined.
(Rev. 1) The following additional comments are necessary due to changes to the plan made
since the last submittal of the plat.
a. Please refer to road section and ROW width comments made during the review of
Lewis and Clark Extended on the property to the south. More ROW will be needed on
this parcel than is being dedicated with this plat.
b. The spillway location of SWM 11 will need to be relocated. Please refer to the latest
WPO /site plan comment letter for greater detail.
c. Future plan revisions may require additional comments on this plat.
