Subject: SUB - 2010 -039- Brown- Family Division
The Planner for the Zoning & Current Development Division of the Albemarle County
Department Community Development will recommend approve the plan referred to above when
the following items have been satisfactorily addressed. (The following comments are those that
have been identified at this time. Additional comments or conditions may be added or eliminated
based on further review.) [Each comment is preceded by the applicable reference to the
Albemarle County Code.]
1. [14 -302 (A)(10)] Right of further division of proposed lots. Revise the notation to state
the following: The residue contains no development rights and cannot be further divided.
The three remaining development rights are assigned to lots 1, 2, and 3, therefore there
are none remaining.
2. [14 -302 (A)(11)] Instrument creating property proposed for subdivision. Include Deed
Book 2463 Page 485 in the references for the property. This deed contains the plat that
shows the current configuration of the lot and states the development rights.
3. [14 -302 (13)(7)] Reservoir watershed. This notation is incorrect. The property lies in the
Totier Creek Watershed, revise to state this.
4. [14 -303 (S)] Control points. Provide at least four (4) control points, evenly distributed
across the property and located at survey property corners, and shown on each sheet
depicting the property. At the option of the subdivider, the control points may be shown
on a copy of the final plat, rather than on the original final plat.
5. [14 -211 and 14 -212 (A)] Verification of Family Division. Provide a copy of an affidavit,
deed, or letter from attorney stating: grantee, grantor and their relationship; and certifying
that this is a Family Division in accordance with Section 14 -208 and related provisions of
the Albemarle County Code. A template is attached.
6. [14 -212 (B)] Family subdivisions; conditions of approval. The subdivider shall place a
restrictive covenant on the lots created by the family subdivision prohibiting the transfer
of the lots so created to a person who is not a member of the immediate family for the
retention period after the date of recordation. A template for this covenant is attached.
7. [14 -212 (C); 14 -316] Approval of entrance on public streets. VDOT approval is required.
Provide a statement from VDOT granting their approval.
8. [14- 308.1] Groundwater assessment. This subdivision requires a groundwater
assessment. Provide the proper fee for this assessment. Contact the Community
Development front desk for fee amount.
9. [14 -309; 14 -310] Soil evaluations; Health Director approval of wells and /or septic
systems. Provide three copies of the results of percolation tests or other methods of soil
evaluation used to determine the suitability of the soil for septic systems with
conventional drain fields for review and approval by the Health Department.
