SUB - 2011 -006- Old Trail Block 23- Final Plat
The Planner for the Zoning & Current Development Division of the Albemarle County
Department Community Development will recommend approve the plan referred to above when
the following items have been satisfactorily addressed. (The following comments are those that
have been identified at this time. Additional comments or conditions may be added or eliminated
based on further review.) [Each comment is preceded by the applicable reference to the
Albemarle County Code.]
1. [14- 302(B)(10)] Stream buffers. Provide the following note on the plat: "The stream
buffer(s) shown heron shall be managed in accordance with the Albemarle County Water
Protection Ordinance."

2. [14- 303(G)] Ownership of common areas. Provide the intended ownership of all the
common areas.

3. [14- 303(H)] Monuments. Provide the location and material of all permanent reference
monuments.

4. [ 14- 303(N)] Statement pertaining to private streets. Provide the following notation on the
plat since there is a private street: "The streets in this subdivision may not meet the
standards for acceptance into the secondary system of state highways and will not be
maintained by the Virginia Department of Transportation or the County of Albemarle."

5. [14 -317] Instrument evidencing maintenance of certain improvements. Provide a private
street maintenance agreement for review and approval by the County Attorney for the
proposed private street.
Revl: Comment not addressed. Maintenance agreement has not be submitted.
Rev2: Comment not addressed. Maintenance agreement has not been submitted.
6. [14 -400] Minimum lot requirements. Provide with a notation the required setback per the
Code of Development for this block.
Revl: Comment addressed.
7. [14 -422] Sidewalks and planting strips. Sidewalks and planting strips are required on
both sides of each new street within a subdivision creating lots for single family detached
and single family attached dwellings in the development areas. Provide street trees and
sidewalks in accordance with this section of the ordinance.
Revl: Comment not addressed. Sidewalks and planting strips must be shown on the
subdivision plat. Street trees are required during the site plan per the Zoning
Ordinance, however the sidewalks and planting strips are a requirement of the
Subdivision Ordinance.
Rev2: Comment not addressed. Show the sidewalk and planting strip on Baywick
Circle. The requirement is that sidewalks and planting strips be on both sides of a
new street. Also state that the sidewalk and planting strip to be conveyed to the
HOA for ownership and maintenance.

....... was approved as a Preliminary Site Plan. Please
note that the approval of this subdivision plat, essentially makes SDP2010 -026 null.
Revl: Comment not addressed. The proposed changes to this subdivision and the
site plan that was submitted (SDP2011 -13) do not match, nor do they match the
rezoning plan. The site plan shows a common area in the center of the development,
however, the common area was taken out of the subdivision plat. Also, this plat
cannot be approved until the site plan is approved.
