I have used Elizabeth Marotta's 12/4/09 comments to conduct the review. The comments below are Elizabeth's original review comments edited to reflect the review of the most recent information. [Addressed comments have been marked with a s#ileugh.] a • MIN 2. [Sec. 14- 302B7] Agricultural forestal district. COMMENT: Please revise note to read "The property shown herein is not located in an Albemarle Agricultural - Forestal District." The provided note on the plat reads "The property shown herein is not located in an Albemarle — Charlottesville Forestal District ". The note must read "The Dronertv shown herein is not located in an Albemarle Agricultural- Forestal District." 4. [Sec. 14 -303E] Dimension standards and information. COMMENT: Please label the proposed new street easement as "New 30' private street easement ". This comment has not been addressed. 5. [Sec. 14 -303R] Private road in rural areas. COMMENT: Provide note verbatim as required by this section. This comment has not been addressed. Add the following language to the plat "All subsequent divisions of the residue shall enter only onto such street(s) shown on the approved final plat and shall have no immediate access onto to any public street." 7. [Sec. 14 -303L, 14 -316] Approval of entrance on public streets. COMMENT: VDOT approval of is required. Sight distance easement may be required. VDOT has stated a sight distance easement will be required. No easement is shown. I have forwarded the plat to VDOT for additional comment. 8. [Sec. 14 -317] Instrument evidencing maintenance of certain improvements. COMMENT: Submit a Private street maintenance agreement for review and approval. A template can be found at: http : / /www.albemarle.org/deptforms. asp ?section _ id = &department = cdapps Private street maintenance agreement has been received and is under review. Final approval of the maintenance agreement cannot occur until the private street is approved. 9. [Sec. 14 -303S] Control points. COMMENT: Please provide control points as required by this section. Comment not addressed. 10. [Sec. 14 -400] Minimum lot requirements. COMMENT: Provide setback lines and dimensions on the plat to ensure existing buildings conform to setback/yard requirements. The trailer on the residue parcel appears to be approximately 20 feet from the property line. The required setback is 25 feet. Provide an accurate dimension to verify this structure meets setbacks. The garage on the lot 1 appears to be gpproximately 20 feet from the property line. The required setback is 6 feet. Provide an accurate dimension to verify this structure meets setbacks. 11. [Sec. 14 -404, 14 -306] The proposed private street easement across TMP 8 -33C creates a situation where the subdivision now includes 3 lots and the private street is technically serving three lots, resulting in the need for Planning Commission approval of the proposed private street (Sec. 14 -232) and the need for a waiver of Sec. 14 -404. Section 14 -404 states that a lot may only be served by one street created at the time of the subdivision. Because TMP 8 -33C would not gain sole access from the proposed private street easement, a waiver would be required. You have two options. You may either do a boundary line adjustment between TMP 8 -33C and TMP 8- 34C so that the new private street easement is entirely within TMP 8 -34C, OR, you may request a waiver of Sec. 14 -404 (per Sec. 14 -404C) and request private street authorization from the Planning Commission as set forth in Sec. 14 -306. The design you have elected to pursue a design that requires a modification of Section 14 -404. No information required by Section 14 -404C has been submitted. Without the information required by Sections 14 -404C and 14 -306 this item cannot be scheduled for Planning Commission review. Without Planning Commission approval this project cannot be approved. 12. [Sec. 14 -420] Location of utilities. COMMENT: Label all utilities shown on the plat. What appears to be an electric power /telephone line is shown on the plat. However, no label is provided. In my letters to you of January 19, 2011 and April 15, 20111 included one additional comment: Health Department approval is still required. Soils work for Lot 1 has been submitted and forwarded to the Health Department for review. No soils work for the residue has been submitted. Health Department approval is required for both Lot 1 and the Residue to insure that adequate area for subsurface drainfields exist on both lots. In order for your application to be approved all of the above items must be addressed. Staff cannot process your private street request or the waiver of entrance requirements until the information required by Sections 14 -306 and 14 -404C has been submitted. If no additional information is submitted to address the above items staff will take action on this application no later than July 23, 2011. If no additional information is submitted that action will be to deny the application. If the information required by Sections 14 -306 and 14 -404C is submitted staff will schedule this item for Planning Commission consideration.
