RE: Tax Map 56, Parcel 113 (404 Waiver)
Dear Mr. Ray
You have submitted a request for waiver of the requirements for a single point of access for a
possible division of the above referenced parcel. This access regulation and waiver criteria are
found in Chapter 14, Section 404 of the Albemarle County Code.
In order to approve the waiver the following findings must be met:
In approving a waiver, the agent shall find that requiring the extension would not forward
the purposes of this chapter or otherwise serve the public interest; and granting the waiver
would not be detrimental to the public health, safety or welfare, to the orderly
development of the area, to sound engineering practices, and to the land adjacent thereto.
It is my opinion that requiring a single point of access would not forward the purposes of this
chapter or otherwise serve the public interest. Based on the three reasons given on your waiver
application, I concur that
1. State Route 683 is the dividing line between lot A and the Residue. It would be
impossible for Lot A and the residue of Tax Map and Parcel 56 -113 to use the same
access to the building site.
2. The existing dwelling on Tax Map and Parcel 56 -113 is currently accessing State Route
683 from an existing Ingress and Egress easement (D.B. 298 -12) passing through the
adjacent property (Tax Map and Parcel 56 -113A) North of its frontage on State Route
683, and
3. The residue of Tax Map and Parcel 56 -113 has four development rights. However
according to stipulations in the conservation easement to the County of Albemarle, the
residue may be divided into not more than two lots containing approximately 133 acres
each.
I find the above reasons to be justifiable, and along with the entrance approval received from the
Virginia Department of Transportation, I hereby approve of the 404- waiver.
