have reviewed the third submittal and have the following comments:
The new plan provides additional information, but not all necessary information for us to
administer and enforce this in the event it is approved.
a. One of the most critical features to tie down for the RA garages is the allowed building
size and parking / paving area size. This is particularly important in a case such as this
in which some of the current improvements are in the WPO buffer. The current plan
does not adequately show the existing edge of pavement. The paving line seems to
disappear on the side of the garage adjacent to the creek and PS 6. Please have the
plan revised to show the existing edge of pavement. Without this detail, it will be very
difficult to determine if any expansions occur in the future.
b. Please revise the plan to show the vegetative buffer that we understand is proposed.
We will need information as to location, number and type of plantings in order to
administer this site plan and special use permit.
c. Since the plan does not indicate any outdoor equipment other than the existing air
compressor, fuel tank and air conditioner, no additional equipment may be located
there in the future without consideration of compliance with the approved plan.
2. It is not typically Zoning's role to weigh in on whether this is an appropriate use at this location.
We will review draft conditions and appreciate having them in advance. Please consider the
following comments:
a. Condition #1 please add a bullet "extent of paving." If the garage is not allowed to
expand without amendment to the SP, bullet #2 should add "size" to "location of
buildings and structures.
b. Because the use has commenced prior to SP approval and compliance with the
conditions, please add a condition stating "The use shall not lawfully commence until
the Special Use Permit is approved and all applicable conditions of approval have been
met." This is to avoid the argument that the SP is approved, therefore he's not in
violation if the conditions have not been met.
c. Please revise the last sentence of condition #8 to clarify "business or earth disturbing"
activities. The applicant is entitled to private residential activities such as a picnic by
the stream.
d. Condition #11 — I think this is extremely hard if not impossible to enforce. If someone
has a breakdown and gets their vehicle towed, the tow truck is not going to wait until
the business is open to take the car there.
e. Condition #12 — would you allow members of the family residing on the premises to be
an employee? If yes, you should mention that exception.
f. Condition #13 — you should confirm that DEQ approval is required or state, "if
required."
