Zoning Clearance CLE 2011 -105, The Gym
Tax Map Parcel 09000- 00 -00- 035X0, 1524 Viola Way, Zoned Light Industrial (LI)
Dear Mr. Tooley,
This letter is in response to your appeal application and new information provided regarding the
Zoning Clearance dated May 31, 2011 for The Gym (Attached). Based on the new information,
including what we learned in our site inspection of The Gym on July 26, 2011, 1 am hereby
rescinding the determination of June 1, 2011 denying your Zoning Clearance application for The
Gym. I am approving your Zoning Clearance as of the date of this letter.
In our letter of June 1, 2011, your application for a clearance was denied because the use was
considered an Indoor Athletic Facility. Indoor athletic facilities are only permitted in the Light
Industrial zoning district with an approved special use permit. Based on the new information you
provided and based on our own observations of the use, our decision as to the appropriate use
classification has changed. Since the majority of your use focuses on training and educating
your clients, which include other professional athletic trainers, the use is now classified as a
scientific or technical education facility under Albemarle County Code Section 18.27.2.1(7)
which is permitted by -right in the LI Zoning District. Your use is distinct from an indoor athletic
facility such as a gym, in that training is the primary purpose and activity.
With this approval, your application for an appeal (AP2011 -05) is moot and we will work to issue
