HomeMy WebLinkAboutSUB201000119 Review Comments Preliminary Plat 2011-09-02� /RCir�1Q County of Albemarle Department of Community Development Memorandum To: Scott Collins From: Megan Yaniglos- Senior Planner Division: Zoning & Current Development Date: October 5, 2010 Revl: December 17, 2010 Rev2: September 2, 2011 Subject: SUB - 2010 -119- The Granger- Preliminary Subdivision Plat The Planner for the Zoning & Current Development Division of the Albemarle County Department Community Development will recommend approval of the plan referred to above when the following items have been satisfactorily addressed. (The following comments are those that have been identified at this time. Additional comments or conditions may be added or eliminated based on further review.) [Each comment is preceded by the applicable reference to the Albemarle County Code.] 1. [Chapter 18] A special use permit for fill in the floodplain is required for Road `13'. Please submit an application, fee, and all information needed for the review and approval of the special use permit. The preliminary plat will not be approved until the special use permit is applied for and approved. Revl: Special use permit applications have been received and are being processed. They will need to be approved before the approval of the preliminary subdivision. Rev2: Same as above. Special use permit applications are currently being processed. 2. [14- 302(A)(1)] Name of subdivision. The requested proposal is a subdivision not a site plan. Please change the title and all reference and notes to read `Preliminary Subdivision Plat'. Revl: Comment addressed. 3. [14- 302(A)(2)] Vicinity Map. The map shown on the cover states the scale as 1" =200'. Is this correct? If so, it should be 1 "= 2000'. Revl: Comment addressed. 4. [14- 302(A)(4)] Private easements. Provide a letter from the owner of TMP 7613-1 for the consent of the construction and connection of `Road' B to Stribling Ave. through their property. Revl: Comment not addressed. Provide consent letters. Rev2: Since the boundary lines have been confirmed, the adjacent owner(s) will need to be a part of the subdivision and sign the plat. The road is going through the adjacent property, and therefore the owner(s) need to sign. The adjacent owner(s) will also need to be a part of the Special Use permit application for Stream Crossing #1. 5. [14- 302(A)(5)] Public easements. There is grading and lots being proposed in the existing Central Telephone Co of Virginia Easement and the Virginia Power Easement. Provide a letter stating that work in and buildings are acceptable in these easements. Revl: Comment not addressed. Provide consent letter. Rev2: Comment not addressed. Still awaiting letters from the utility companies. S. [ 14- 302(A)(8)] Proposed lots. The parcel boundary lines shown on the County GIS do not match what is shown as the "Project Boundary" on the plat. There are areas that are not accounted for, are these proposed lots, open space? Show the correct parcel boundary on the plat to assure the correct information is being shown. Revl: Comment not addressed. An official determination for the parcel boundary will need to be done by the zoning administrator. Please submit the enclosed application and fee and information so that this can be processed. Rev2: Comment addressed. 7. [14- 302(A)(9)] Building site on proposed lots. Provide the following note on the plat: "Lots 1 -69 each contain a building site that complies with section 4.2.1 of the Albemarle County Zoning Ordinance." Revl: Comment addressed. Rev2: Need to confirm that there are building sites on the lots. There is question as to whether Lots 70, 71, and 72 do in fact contain a building site. 20,000 square feet needs to be provided outside of the buffer, and critical slopes. Provide a diagram that outlines the building site information. S. [ 14- 302(B)(4)] Places of burial. Show location of graves/burial ground on the plat. Revl: Comment addressed. 9. [ 14- 302(B)(7)] Reservoir watershed; agricultural forestall district. State that the property is not in an agricultural forestal district. Revl: Comment addressed. 10. [14- 302(B)(10)] Stream buffers. Provide the following note on the plat: "The stream buffer(s) shown heron shall be managed in accordance with the Albemarle County Water Protection Ordinance." Revl: Comment addressed. 11. [14 -304] Critical slopes. A waiver request has been submitted. The Planning Commission will need to review and approve this request. Revl: This modification will be taken to the Planning Commission along with the SP's, sidewalk modification, and the proposed open space. Rev2: Same as previous comment. 12. [14 -409; 14 -429] Coordination and extension of streets; Reservation of land for streets, alleys, walkways, waterways or public areas shown on map. A connection between Sunset Ave. and Fontaine Ave. must be provided per the Comprehensive Plan. Please see Claudette Grant and Phil Custer's comments for more information on this requirement. Revl: Comment addressed. 13. [ 14 -429] Reservation of land for street, alleys, walkways, waterways or public areas shown on map. A greenway along Moore's creek is proposed in the Comprehensive Plan. Reservation of land for this greenway is required. Please see Claudette Grant's comments for more information on this requirement. Revl: Comment addressed. 14. [14-421] Monuments. Provide the location and material of all permanent reference monuments. Monuments found or installed prior to plat recordation may be referred to if they are permanent and undisturbed. All boundaries, both exterior and interior, of the original survey for the subdivision shall be monumented. Revl: Comment addressed. 15. [14 -422] Sidewalks and planting strips. Sidewalks and planting strips are required on both sides of the street. Request a modification of this requirement for Road `C' and Road `A'. This modification will need to be approved by the Planning Commission. Revl: Modification has been received and will be taken to the Planning Commission along with the SP's and other modification requests. Also, take a look at the street trees at the proposed crossings and determine if some of them are feasible in that situation. Rev2: Same as previous comment. 16. [13.4.2] Bonus Density. Please clarify if the proposed open space will be dedicated to public use or maintained privately. If dedicated to public use, the Board of Supervisors will need to approve it. If privately owned, a maintenance agreement will be required during final plat approval. Rev1: The open space request will be taken to the Planning Commission and then the Board of Supervisors along with the SP's and other modification requests. Rev2: Clarify that the open space shown in front of lots 44 -55 is just an easement, and not dedicated to the County. Also, state if it will be HOA maintained. 17. [4.7(c)(3)] Limitation on certain elements in open space. Provide calculations on the open space that not more than eighty (80) percent of the minimum required open space consists of the following: (i) land located within the one - hundred year flood plain; (ii) land subject to occasional, common or frequent flooding as defined in Table 16 Soil and Water Features of the United States Department of Agriculture Soil Conservation Service, Soil Survey of Albemarle County, Virginia, August, 1985; (iii) land in slopes of twenty -five (25) percent or greater; and (iv) land devoted to stormwater management facilities or flood control devices, except where the facility or feature is incorporated into a permanent pond, lake or other water feature deemed by the agent to constitute a desirable open space amenity. Rev1: Please provide a separate exhibit of the open space and the acreage inside an outside of the areas described in the ordinance. This will only help for clarification when we take this request to the Planning Commission and Board. Also, provide the exact language on the note on the cover sheet of section 18- 4.7(c)(3) that spells out all of the above for the areas (i.e. The open space that not more than eighty (80) percent of the minimum required open space consists of the following: (i) land located within the one - hundred year flood plain; (ii) land subject to occasional, common or frequent flooding as defined in Table 16 Soil and Water Features of the United States Department of Agriculture Soil Conservation Service, Soil Survey of Albemarle County, Virginia, August, 1985; (iii) land in slopes of twenty -five (25) percent or greater; and (iv) land devoted to stormwater management facilities or flood control devices, except where the facility or feature is incorporated into a permanent pond, lake or other water feature deemed by the agent to constitute a desirable open space amenity.) Rev2: Show the proposed greenway trail on the open space exhibit. Also, the greenway trail ends right before Sunset Ave Extended, revise to make the connection all the way to Sunset Ave. Additional Comments: On the cover sheet there is a notation indicating that this is a rezoning for the bonus density, which it is not, please remove this note. Rev2: Comment addressed. However, on the cover sheet in reference to the open space a note states that this is PRD zoning, which it is R -1 zoning. Revise On the cover sheet the notation that references the landscaping and street trees states that this requirement is for a site plan and will conform to Chapter 32, when the street tree requirement is in the subdivision ordinance- Section 14 -422. Revise this note to state that it is a subdivision and reference the correct ordinance section. Rev2: Comment addressed. For Final Plat Approval: 1. [14- 303(A)] Statement of consent to division. Provide the following statement above the signature and notary panels on the plat: "The division of the land described herein is with the free consent and in accordance with the desire of the undersigned owners, proprietors and trustees. Any reference to future potential development is to be deemed as theoretical only. All statements affixed to this plat are true and correct to the best of my knowledge." 2. [14- 303(C)] Boundary lines. Are the boundary lines shown the limits of the project, or the actual boundary lines of the parcel? It appears that the parcel boundary that is shown is different from the county parcel boundary in GIS. Please clarify. 3. [ 14- 303(G)] Ownership of common areas. Provide the intended ownership of all common open space areas. 4. [14- 303(H)] Monuments. Provide the location and material of all permanent reference monuments. Monuments found or installed prior to plat recordation may be referred to if they are permanent and undisturbed. If any monument by this chapter will be installed after recordation of the final plat, the certification of the professional engineer or land surveyor shall so note. 5. [14- 303(M)] Proposed street names. Provide the proposed street names for review and approval. 6. [14- 303(N)] Statement pertaining to private streets. For the private alley provide the following note: "The private alley in this subdivision may not meet the standards for acceptance into the secondary system of state highways and will not be maintained by the Virginia Department of Transportation or the County of Albemarle." 7. [14- 303(0)] Signature panels. Provide signature panels for each owner and for the agent or his designee. The signature panel for the owner shall be located immediately below the statement required by Section 14- 303(A). 8. [14- 303(P)] Notary panels. Provide notary panels for the notary to acknowledge the signature of the owner. 9. [14- 303(Q)] Water supply. Provide a statement that the subdivision will be served by public water and sewer on the plat. 10. [14- 303(S)] Control points. Provide at least four (4) control points, evenly distributed across the property and located at survey property corners, and shown on each sheet depicting the property. At the option of the subdivider, the control points may be shown on a copy of the final plat, rather than on the original final plat. 11. [14 -316] Approval of entrance on public streets. VDOT approval is required. Provide a statement from VDOT granting their approval. 12. [ 14 -317] Instrument evidencing maintenance of certain improvements. Provide a maintenance agreement for the common open space and for the private alley for review and approval.
