The following comments are provided. 1. The conservation area along Flat Branch appears to match the area shown on the preliminary site plan that was conditionally approved on April 24th 2009. During the review of this preliminary site plan, there was some question as to whether the conservation area matched the approved application plan and a condition to site plan approval was added that required a "written certification from a licensed surveyor or engineer confirming that the conservation line shown on the application plan ... and the conservation line shown on the site plan are in the exact same location" be provided to the county. The applicant should provide this certification now, noting the change to the conservation area required by the county per comment #3 below. (Rev. 1) The note has been added to the plan and will need to be signed by the surveyor. 2. The various ESC plans currently under review shows construction activities, not to mention the mitigation work, within the conservation area along Flat Branch that is to be dedicated to the county. Dedicating the conservation area to the county before all this work is done will create legal issues with the county allowing construction on publicly owned land. The Flat Branch conservation area must be "reserved for dedication upon demand by the county" instead of dedicated at this time. (Rev. 1) Comment has been addressed. 3. After consulting with the Zoning Administrator, Chief of Current Development, and the County Attorney, it was discovered that the existing construction and access easements to TMP 32 -22K1 through county owned land would be problematic. Therefore, the conservation area must be reduced so that it does not include any of the access and construction easements platted on Page 648 of Deedbook 1663. (Rev. I) Comment has been addressed. 4. (Rev. 1) Similar to comment 2, it may be advisable for the applicant to reserve for dedication the land that would need to be disturbed for the construction of the sewer line from the single family residential area. Since the first review of the plan, the owners of TMP 32 -23 have approached the county with conceptual sewer alignment and grading plans showing disturbance in GI, which would be dedicated to the county with this plat. However, if a small portion of GI was to be "reserved for dedication to public use upon demand of the county ". the county would not need to grant construction and sewer easements when the single family lots are developed.
