RE: Variation Request dated August 23, 2011, which has been made in conjunction with
WPO- 2011 -00019 and SUB - 2011 -00029 — Variation Request for Road Layout, Typical
Road Section and Trail Layout
Dear Mr. Myers:
The County has received your variation request to:
A. Change the approved road layout to meet current VDOT connectivity requirements
B. Change the typical road section to meet current VDOT standards
C. Change the trail location in Phase A to provide required pedestrian access
D. Change the stormwater management facilities to temporarily replace the approved
stormwater facility with a rain garden for Phase A, with the understanding that the larger
facility to serve the entire development will be built during later phases
This letter serves to provide approval of the road and trail variations in keeping with the depictions
on the "2011 Proposed Plan" (prepared by Michael F. Myers, dated 3/15/11) and the attached
application, and the stormwater management variation in keeping with the depiction on the "SWM
Variation Exhibit," an amended copy of the "2006 Application Plan" prepared by Timothy R.
Miller.
The analysis of the variation request is provided below:
Section 8.5.5.3 allows the director of planning to grant minor variations to
Changes to the arrangement of buildings and uses shown on the plan, provided that the
major elements shown on the plan and their relationships remain the same;
Minor changes to street design and street location, subject to a recommendation for
approval by the county engineer; and
Minor changes to the design and location of stormwater management facilities, minor
land disturbance including disturbance within conservation areas, and mitigation, all
subject to a recommendation for approval by the county engineer.
as long as:
1) The variation is consistent with the goals and objectives of the comprehensive plan.
The road variations, which would make the development consistent with more up -to -date
VDOT road standards, are consistent with the Land Use Plan's statement that the County
should "Improve connection and travel throughout the region" and "Improve mobility
within neighborhoods."
The trail variation, which involves adding sidewalks, is consistent with the Neighborhood
Model's "Pedestrian Orientation" principle.
The stormwater management variation is as consistent as the approved facility with the
Natural Resources & Cultural Assets Plan's policies on water quality, provided that the
larger facility is built later to treat the runoff from the entire development.
2) The variation does not increase the approved development density or intensity of
development.
The number of lots and dwelling units would remain the same.
3) The variation does not adversely affect the timing and phasing of development of any
other development in the zoning district.
No changes to the timing of other development would result from this variation.
3) The variation does not require a special use permit.
No special use permit is required.
4) The variation is in general accord with the purpose and intent of the approved
rezoning application.
Variations A, B, and C are approved because the requested changes would allow the
approved development to meet current VDOT standards without changing the overall
form or density of development.
Variation D is approved because the requested changes would still ensure that stormwater
quality is maintained for Phase A, and because the requested changes would be replaced
by the already- approved facilities once construction proceeds beyond Phase A.
