Dear Mr. Collins
You have requested a waiver to allow the construction of parking spaces that do not meet the minimum
requirements of the ordinance. (8 feet wide instead of 9 feet wide and no curbing provided) After
reviewing the modification provisions of Section 4.12.2(c) I am unable to make a finding that the
modification would equally or better serve the public health, safety or welfare. Your justification is that
8 foot spaces are appropriate because the lots for affordable units are proposed as 16 feet wide. While the
provision of affordable housing is encouraged, the County does not support the reduction of minimum
design standards to achieve affordable housing. Your justification is more appropriately applied as a
justification to amend the Zoning Ordinance. If this modification were to be granted it would not be
possible to distinguish this modification from any other modification requested for affordable housing.
While the parking is proposed on proposed individual lots the spaces function as a bay. The County
Engineer's representative is unable to find that waiving the curbing requirements would equally or better
serve the public health, safety or welfare and I agree with his recommendation.
Based on the above findings the request for modification of design standards is denied. This denial may
be appealed as provided for by Chapter 18, Section 4.12.2(d) of the Code of Albemarle.
