RE: SUB - 2010 -90, Briarwood (Phases IA -2, 113-2 & 8) Final Plat
Dear Sir or Madam:
The Department of Community Development hereby grants administrative approval to the above referenced
final subdivision plat.
The final plat is valid for five (5) years from the date it is approved pursuant to Section 14 -228 of Chapter 14 of
the Albemarle County Code, provided that the subdivider diligently pursues approval of the final plat. After
three (3) years (November 7, 2014) following final plat approval, the agent may, after ninety (90) days' written
notice provided by certified mail to the subdivider, revoke the approval upon a specific finding of facts that the
subdivider failed to diligently pursue approval of the final plat.
Please address all of the requirements and conditions listed below and submit eight (8) tentative plat copies to
the Department of Community Development. This letter must be submitted with the tentative plats, as a
checklist, to document that you have addressed all requirements or conditions, or the tentative plat will be
denied.
Erosion and Sediment Control, BMP Stormwater Management, and road plans with the associated applications
and fees must also be submitted with the eight (8) tentative Plats.
Once the tentative plat is submitted and reviewed you will receive comments from all
departments /divisions /agencies that have made comment on the tentative plat. Any further responses
must be made directly to each department /division /agency that has further comment. After all
aforementioned departments /divisions /agencies have granted a tentative approval, you must verify with
the Planner that you may submit the final plat mylar or other media original and any remaining fees to
the Department of Community Development. Assuming that the final plat reflects all tentative approvals,
signing of the plat will occur within four days.
The final plat will be subject to all final plat requirements (Subdivision Ordinance Section 14.206), in addition
to the following conditions.
The Department of Community Development shall not accept submittal of the final plat for signature until
tentative approvals for the following conditions have been obtained. The final plat shall not be signed until the
following conditions are met:
Planning Services approval to include:
❑ [14 -303F] COMMENT: Per proffer 4, one tot lot shall be provided in Phase 113. Please revise
Sheet 2 of 9 to indicate the location of the proposed tot lot in Phase 1B.
❑ [14 -303G] COMMENT: Per Proffer #1 (which supercedes the ordinance) recreation areas must
be conveyed to the Homeowners Association. For this reason, they must be platted separately,
unless you decide to dedicate all open space to the HOA, in which case they can be just part of
the common open space that gets dedicated (see comment #19 below). You may include
maintenance of the tot lots in the maintenance agreement for the private streets (and common
open space if it is dedicated to the HOA).
❑ [14 -317] Instrument evidencing maintenance of certain improvements. COMMENT: Per
comments above, please submit maintenance agreements for County Attorney review, for tot
lot, open space, and road maintenance, as well as any documents required by Engineering.
❑ [14 -414, 430] Public water and sewerage, Dedication of water and sewerage system.
COMMENT: ACSA approval is required. Provide verification once approval is obtained.
❑ [Sec. 14 -417, 43 1] Stormwater management and drainage control facilities, easements for
facilies for Stormwater management and drainage control. COMMENT: Engineering
approval is required.
❑ [Sec. 14 -426, 428] Dedication of land for public use, Dedication of streets. COMMENT:
VDOT approval is required. Provide verification once approval is obtained.
❑ [Sec. 14- 434,435, 435.1, 436] Completion of on -site improvements required prior to plat
approval, surety for maintenance of streets until accepted into state system, release of surety.
COMMENT: Streets and required improvements must be built or bonded prior to final plat
approval. Please see Engineering comments for more information concerning request for bond
estimate, etc...
❑ [14- 234.C.3] COMMENT: The private street(s) must be owned by the Homeowners
Association. Note #15, Sheet 1, needs to be revised to reference a time at which the conveyance
will occur. Remember, a maintenance agreement is required.
