Erik,
I hope you are doing well. I wanted to apologize for incorrectly calling our determination for the special use permit
validity a "vesting decision." Greg Kamptner reminded me that it's actually a commencement of use determination. I
also should have let you know that I've asked Sarah Baldwin to take the lead on this review and determination. She
communicated with you about this previously. Ellie from Current Development, provided us with a copy of the letter of
site plan revision (LOR) that was submitted at the end of last month. Sarah and I just sat down and went over it.
Until we determine whether or not the special use permit is valid, we can't approve the LOR. If the special use permit is
valid, there are several outstanding conditions of approval that need to be met. If it is not valid, the special permit is a
non - issue. If the special use permit is not valid, they can resubmit for re- approval. I think there's a previous special
permit, so this is an amendment and will cost $1000 for the application.
Anyway, just let us know how you wish to proceed. If you would like us to find that the special use permit is valid,
please provide additional information (with a timeline) as to what was done to commence the use. (I think you have the
ordinance language on this.) Just let us know.
