To Whom it May Concern:
In response to your request for a Letter of Zoning Compliance for the above referenced
Property, please be advised of the following:
• The Property is zoned Light Industrial ("LI"). The permitted uses of the LI zoning district are
provided in Section 26 & 27 of Chapter 18 of the Albemarle County Code ("Zoning
Ordinance"), linked below. The property is subject to the Entrance Corridor, Steep Slopes,
Flood Hazard, and Airport Impact Area Overlay Districts as described in Section 30 of
Chapter 18 of the Zoning Ordinance. The property is not part of a planned development.
The Property abuts the Seminole Trail right-of-way and is subject to Section 30.6 - Entrance
Corridor Overlay District. Approval of outdoor storage, display and/or sales serving or
associated with a permitted use that is visible from the EC must be granted through
obtaining a Special Use Permit.
The Property is subject to Section 4.14 — Performance Standards. A Zoning Clearance must
be obtained prior to establishment of a new non-residential use, change or intensification of
an existing use, or change of occupant, per Section 31.5. Prior to the issuance of a zoning
clearance or approval of a final site plan, each prospective occupant of a use of an industrial
character must submit a Certified Engineer's Report for review of compliance with
performance standards. To the best of my knowledge, there are no prohibitions of the
Zoning Ordinance regarding 24/7 operations if the proposed use adheres to the
aforementioned performance standards.
• The Property is subject to Zoning Map Amendment ZMA198100019, approved July 1, 1981,
which rezoned the Property from Rural Areas to Light Industrial.
The Property was originally developed with Site Development Plan SDP198700008,
approved September 16, 1987, for the construction of one 12,000sf warehouse and
associated parking. This plan was later amended by, and is currently subject to,
SDP199900133, approved February 17, 2000, for the construction of an additional 48,000sf
warehouse and office with associated parking. Further modifications or improvements to the
Property may necessitate an amendment to this plan and are subject to review for
compliance with Entrance Corridor regulations.
• The Property is subject to Variance VA199100037, approved October 8, 1991, with regard
to signage.

• There are no additional Special Use Permits, Special Exceptions, Zoning Map Amendments
or Variances associated with the Property.
• Information regarding Certificates of Occupancy may be obtained by contacting the
department's Building Division: Michael Dellinger (mdellincier(c).albemarle.oro) or Betty
Slough (bSIOUgh(a)albemarle.orcI). Copies of existing Certificates of Occupancy may be
obtained via request through the department's Records Manager, Paul Bjornsen, as noted
below.
• Zoning designations adjacent to the Property are as follows: North: Rural Areas, South:
Heavy Industrial, East: Planned Residential Development, West: Seminole Trail right-of-way.
Adjacent zoning designations may be viewed on the Zoning Map, linked below.
• To the best of my knowledge, the Property is currently in compliance with all applicable
requirements of the Zoning Ordinance. A review of our files found (i) no pending zoning or
building violations applicable to the Property (ii) no fees due or pending with respect to any
matter before the County Zoning Office and (iii) no pending application for rezoning of the
Property or for a special or conditional use permit or variance in connection with the
Property. Further, no proceedings to challenge the zoning or other governmental approval or
use of the Property is pending or overtly threatened to the best of my knowledge.
• If the Property contains physical development approved with a site plan, then in the event of
casualty, the Property may be rebuilt substantially in the same form upon satisfaction of all
required building permits and site plans, as applicable. The threshold that would necessitate
a new use permit, variance, or other approval is unknown until a proposal is made.
• Albemarle County's Zoning Division has no record of current or future plans for roadway
construction, easements, land condemnation proceedings, or other activity that would
impact the placement of property lines, affect immediately surrounding rights -of -way, or
disrupt traffic flow in proximity to the Property.
• To the best of my knowledge, the Zoning Map and Zoning Ordinance information available
on the County website is current and accurate.
• Copies of any relevant records may be obtained via the noted links or the Community
Development Department Records Public Access link below. If unable to find the records,
then a request through the department's Records Manager, Paul Bjornsen, at
pbiornsen(a)albemarle.oro may be made. If the request is not based in Virginia, it will take
longer to fulfill.
