Subject: SUB2020-00002 EKM Properties, LLC — BLA
The County of Albemarle Planning Division will grant or recommend approval of the plat referenced
above once the following comments have been addressed: [Each comment is preceded by the applicable
reference, which is to the Subdivision/Zoning Ordinances unless otherwise specified.]
1. [14-302(A)10] The right of further division for TMP 139A-21, as stated in note C, indicates
that there are only four division rights remaining. Clarify where the fifth development right is,
as it does not appear that the boundaries of this parcel have changed since 1980.
2. [14-400] Provide a note on the plat that states the setback requirements for these parcels, using
the area and bulk regulations for Rural Areas zoned properties outlined in Section 10.4 of the
Zoning Ordinance.
3. [14-309; 14-310; 14-4161 This subdivision plat requires Health Department approval prior to
approval being granted by the Community Development Department. The soils evaluations for
this property and the proposed subdivision plat have been transmitted for review to the Health
Department. Comments or approval from the Health Department will be forwarded to the
applicant upon receipt by County staff. Soils evaluation is needed for TMP 139A-19A, which is
decreasing in size and is under five acres.

Dear Mr. Reitelbach:
The Department of Transportation, Charlottesville Residency Transportation and Land Use
Section, has reviewed the above referenced Boundary Line Adjustment Plat, as submitted by
Roger W. Ray and Associates, Inc., dated December 17, 2019 and find it to be generally
acceptable.
A VDOT Land Use Permit will be required prior to any work within the right of way. The
owner/developer must contact the Charlottesville Residency land Use Section at (434) 422-9399
for information pertaining to this process.
