Subject: S.P. 2011 -026 Flatwoods Land Trust PWSF — initial Zoning comments
I have reviewed this initial submittal and have the following comments:
1. This property is within the Southwest Mountains Historic District. Please check to see if the
proposal involves area designated within the Open Space Plan (reference 5.1.40 d7).
2. This involves a proposal to modify by increasing the maximum height above the reference tree
from 10 feet to 30 feet, an increase of 20 feet. I am not aware of other approvals under the
current regulations for an increase above the reference tree of this much. I suggest that in
your review, you establish criteria that can be used for other applications.
3. The proposed access road is a significant length (about' /4 mile). The WPO plan to allow the
road grading should include the tree conservation plan as a sheet, to assure the key trees are
saved as proposed.
4. When you do the onsite, please confirm that the proposed ground equipment will be
adequately screened (Section 5.1.40 c2).
5. Section 5.1.40 c7 and most prior special use permits require submittal of an annual report by
July 1St of each year. We have not received the annual report for this personal wireless
provider. Please submit it as soon as possible.
7. The owner of the facility shall submit a report to the agent by no earlier than May or and
no later than July 1 of each year. The report shall identify each user of the existing
structure, and include a drawing, photograph or other illustration identifying which
equipment is owned and /or operated by each personal wireless service provider. Multiple
users on a single tower or other mounting structure may submit a single report, provided
that the report includes a statement signed by a representative from each user acquiescing
in the report.
