The County of Albemarle Division of Current Development will grant or recommend approval of the vacation
plat referenced above once the following comments have been addressed: [Each comment is preceded by the
applicable reference, which is to the Subdivision/Zoning Ordinances unless otherwise specified.]
1. [14- 302(A)3] Existing or platted streets. The location, width and names of all existing or platted streets and
all other rights -of -way. On sheet 2 of the plat label the proposed private road as Ballinger Lane. For the
abandoned portion of the road it shall be permissible to label as, "Abandoned portion of Ballinger Lane ".
2. [14- 232(B)(2)] Private street authorization. A private street may be authorized within a two -lot subdivision
if the division contains only two lots and the private street will serve only those lots and will be the sole and
direct means of access to a public street. Please add a note indicating that the proposed private street will be
the sole and direct means of access onto State Route 6, Irish Road for both Tract A & B.
3. [14- 317]If the subdivision will contain one (1) or more improvements that are not to be maintained by the
county or any authority or other public agency, the subdivider shall submit with the final plat an instrument
assuring the perpetual maintenance of the improvement. Please provide an instrument (deed) that
assures the perpetual maintenance of Ballinger Lane.
4. [14- 302(B)(6)] Tax map and parcel number. On sheet 2 there is a type error with regard to T.M. 119 -5F, it
should read T.M. 119 -56F.
5. [14- 302(B)(5)] Zoning Classification. The zoning classification of the property, including all applicable
zoning overlay districts, proffers, special use permits and variances. On the plat the magisterial district is
incorrectly labeled as Scottsville, it should read Samuel Miller District.
