Dear Mr. Lewis:
In response to your Application for Letter of Zoning Compliance dated December 5,
2011, and email questions dated November 29 and December 6, 2011, please be
advised as follows:
The Property is zoned Neighborhood Model Development ("NMD"), and is
subject to ZMA2002-2 dated August 5, 2003 and a Code of Development
("COD"), dated June 10, 2003. The current use of the building (residential
and commercial units) is permitted under the requirements of the ZMA and
COD. The residential units are permitted to be rented.
To the best of my knowledge, the Property is not in violation of any
subdivision, platting or building or zoning requirements, with the exception of
a proffer that is detailed below.
■ The Property is in violation of Proffer 4, regarding the greenway trail. The
County has called a bond in the amount of $18,000 to complete construction
of the trail.
■ The Property has 56 permanent certificates of occupancy for the residential
units. No certificates of occupancy exist for the unfinished commercial
spaces. The shell building is subject to a temporary certificate of occupancy
pending completion of the building (copies are attached).
■ The property meets all access and parking requirements required by the
Albemarle County zoning ordinance and is in compliance with the current
zoning ordinance of Albemarle County, including all provisions regulating
setback, density and height. There are no restrictions to assigning parking
spaces.
No roads are complete or accepted for public maintenance. The developer is
responsible for completion and acceptance of the roads. All roads are
bonded, including Livingston Drive.
■ The current development was originally built under a site plan, SDP2006-50
approved February 16, 2007 (copy provided) and subject to a subdivision
plat, SUB2006-191, dated December 28, 2006. To my knowledge, there are
no subsequent amendments to the plans.
The SWM facility directly behind the condominiums is a regional facility used
by the all the properties within the drainage area. A critical resource map is
attached that depicts the contours. Private contractors are in the process of
converting the pond to the SWM facility, which still requires stabilization and
plantings. A bond in the amount of $98,300 is currently held by the County
subject to completion of the outstanding items. Although the SWM is
dedicated to the County, construction and maintenance is currently held
under a private agreement with surrounding landowners until the County
accepts the SWM. A Notice to Comply was issued June 18, 2007 for a lack
of drop inlet protections. If further information is required, please contact Ray
Lilly in Engineering Services.
