Private streets may be authorized in the development areas administratively in accord with the provisions of Chapter 14, Section 232(B)(1). The approval of a private street may be granted if the agent makes the fmdings required by Chapter 14, Section 234(C). Those findings are: (The findings are shown in italics.) 1. The private street will be adequate to carry the traffic volume which may be reasonably expected to be generated by the subdivision. The design of the private street has been reviewed by the County Engineer and is adequate for the volume of traffic expected. 2. The comprehensive plan does not provide for a public street in the approximate location of the proposed private street; The Comprehensive Plan shows a street network in this area. The existing proffers for this property require a public street. However, a pending application, ZMA 2011 -07 would authorize a private street. If ZMA 2011 -07 is approved authorizing a private street it is my opinion that a private street would be consistent with the Comprehensive Plan. 3. The fee of the private street will be owned by the owner of each lot abutting the right -of -way thereof or by an association composed of the owners of all lots in the subdivision, subject in either case to any easement for the benefit of all lots served by the street; A maintenance agreement will be required to insure ownership and maintenance of the private street. 4. Except where required by the commission to serve a specific public purpose, the private street will not serve through traffic nor intersect the state highway system in more than one location; and This private street would, after completion of the entire Stonefield development allow for connection of Route 29 and Hydraulic Road thru the use of various private streets within the Stonefield Development. Staff does not view this as providing for through traffic as it not a direct route. Further, intersection with the state highway system in more than one location is desirable for this development as it allows for dispersion of the traffic from the site instead of concentration of traffic at a single point and allows for an improved internal site design. 5. If applicable, the private street has been approved in accordance with section 30.3, flood hazard overlay district, of the zoning ordinance and other applicable law. This provision is not applicable no flood hazard overlay district exists on this property. Based on the analysis above this request for a private street may be approved subject to the following conditions: 1. Approval of a rezoning to permit a private street within the Stonefield Development. 2. Approval of a maintenance agreement. 3. Approval of final road plan design by the County Engineer.
