The County of Albemarle Division of Current Development will grant or recommend approval of
the Boundary Line Adjustment plat referenced above once the following comments have been
addressed: [Each comment is preceded by the applicable reference, which is to the
Subdivision /Zoning Ordinances unless otherwise specified.]
[14- 302(A)(3)] Existing or platted streets. The location, width and names of all existing or
platted streets and all other rights -of -way. For the existing "private road" that the new
easement is being placed over, provide its name and width.
2. [14- 302(A)(10)] Right of further division of proposed lots. On the plat provide the following
notes for development rights so they comply with the ordinance as specific to this property.
"Parcel [letter or number] is assigned [number] development rights and may /may not be
further divided and when further divided these rights shall not comprise more than
[number] acres. The residue of Tax Map /Parcel [numbers] is retaining [number]
development rights and when further divided it shall not consist of more than [number]
acres."
3. [14- 302(B)(1)] General Information. When the plat is revised, please provide the date of the
last revision on the plat.
4. [14- 302(A)(9)] Building sites on proposed lots. On the plat provide a note for buildable area
and slopes so they comply with the ordinance. Provide the following note on the plat: "Tax
Map 109 -6E and the residue of Tax Map109 -6 each contain a building site that complies
with section 4.2.1 of the Albemarle County Zoning Ordinance."
5. [14- 302(B)4] Places of burial. The location of any grove, object or structure marking a place
of burial located on the property. On the plat locate the approximate location of any
cemeteries.
6. [14- 302(8)(5)] Zoning Classification. The zoning classification of the property, including all
applicable zoning overlay districts, proffers, special use permits and variances. The zoning of
the property is not listed on the plat. Revise the plat to provide the zoning information: RA
Zoning District.
7. [14- 302(B)7] Reservior watershed, agricultural forestal district. On the plat provide notation
as to whether the land is within an Albemarle County and /or City of Charlottesville water
supply watershed (this property is not, please state such on the plat) or an agricultural -
forestal district (this property is not, please state such on the plat).
8. [14- 303(A)] Statement of consent to division. On the plat revise the Owner's Statements on
sheet 1 to include the following section: "Any reference to future potential development is
to be deemed as theoretical only. All statements affixed to this plat are true and correct to
the best of my knowledge."
9. The draft private road maintenance agreement deed has been forwarded to County
Attorney for his review. Once he provides me his review I will forward his comments to you.
His comments may generate additional plat modifications.
10. On the plat the Owner's Statement and other portions of the plat reference TMP 109 -6
owner as First Baptist Church Covesville; however, page 1 of the deed refers to the owner
as Covesville First Baptist Church. County records list the owner's as Covesville First Baptist
Church. I am seeking guidance from the County Attorney as to how this should be labeled
and will advise you once I receive his review of the deed.
11. On the plat the Owner's Statement and other portions of the plat reference TMP 109 -4D
owner as Up & Over, LLC; however, page 1 of the deed refers to the owner as Up & Over
Farm, LLC. County records list the owner's as Up & Over Farm, LLC. I am seeking guidance
from the County Attorney as to how this should be labeled and will advise you once I
receive his review of the deed.
