In general, the Rural Area provides for up to 5 development rights on a minimum of 2 acre lots and allows for further division of land with a minimum of 21 acres per division. The Thatch property (Tax Map 57-72) appears to have the potential for 11 additional parcels. The total parcel is 156.164 acres, which could includes 5 development rights (5 dwellings on 2 acre minimum lots), and 6 additional 21 acre lots. These lots could only be developed with appropriate building sites and available drainage area for those sites, which could only be discovered through submittal of a subdivision plat. As an aside, there was a one family division of this property (SUB86-065) for the "existing tenant house," which would mean 1 out of the 5 development rights was used. Further research of the file suggests that the prior use of a development right was switched to another lot and for the prior subdivision to be vacated. I can find no documentation that suggests that the original plat was vacated, nor can I find anything to suggest that an additional lot was created. There are no requirements to upgrade the road serving these lots if done under the requirements for a family subdivision, but any other subdivision would most likely involve a road upgrade if being served by more than 3 lots. This would also be reviewed at application for any subdivision. Please be advised that this information cannot be relied upon as an official zoning determination.
