The Albemarle County Planning Division will grant or recommend approval of the boundary line
adjustment plat referenced above once the following comments have been addressed. [Each
comment is preceded by the applicable reference to the Subdivision Ordinance, unless otherwise
specified.]
1. [14- 302(A)2] Vicinity Map. The level of detail and accuracy of the vicinity map is
inadequate. Please show the property and its relationship with
adjoining land and streets, and its relationship with landmarks in the
area in detail adequate to describe the location of the property
without field review.
2. [14- 302(A)9] Building sites on proposed lots. Please verify that a building site is
available and add the building site note: "Parcel [letter or number]
and the residue of Tax Map /Parcel [numbers] each contain a building
site that complies with section 4.2.1 of the Albemarle County Zoning
Ordinance."
3. [14- 302(A)10] Right offurther division ofproposed lots. Please add the correct
development rights note verbatim with applicable numbers: "Parcel
[letter or number] is assigned [number] development rights and
may /may not be further divided and when further divided these
rights shall not comprise more than [number] acres. The residue of
Tax Map /Parcel [numbers] is retaining [number] development rights
and when further divided it shall not consist of more than [number]
acres."
Revision #1— 02/24/12: The development rights note is not
verbatim and does not appear to be correct. Please complete deed
research and provide a full development rights note. The planner will
also research deeds to determine the precise language of the correct
note.
4. [14- 302(B)1]
General information. Please add date of last revision to the plat
with each revision submitted.
Revision #1— 02/24/12: Date of last revision acknowledged for this
revision. Please add the date of last revision with the each revision
submitted.
5. [14- 302(B)7]
Reservoir watershed. Ballinger Creek is the sub - watershed, not the
water supply watershed/protection area. Please remove (Ballinger
Creek water supply watershed). Alternatively, revise text within
parentheses to indicate that Ballinger Creek is the sub - watershed.
6. [14- 302(B)10]
Stream buffers note. County records on GIS Web indicate that a
portion of a stream buffer is on this site. Please verify in the field and
show the location of the stream, its stream buffer, and add a note that
reads verbatim, "The stream buffer(s) shown hereon shall be
managed in accordance with the Water Protection Ordinance."
Revision #1— 02/24/12: As discussed in- person, by phone, and by e-
mail, the stream buffer needs to be shown and the corresponding
note needs to be added. Alternatively, if field survey indicates that
the stream is no longer there, please fill out the application and
applicable fee to have the County Engineer or a designee conduct a
field inspection to have the stream removed from the GIS system.
7. [14- 303(A)]
Statement of consent to division. Under "Owners Approval ", Please
revise statement of consent to division to read verbatim, "The
division of the land described herein is with the free consent and in
accordance with the desire of the undersigned owners, proprietors
and trustees. Any reference to future potential development is to be
deemed as theoretical only. All statements affixed to this plat are
true and correct to the best of my knowledge." Portions of this
statement are currently missing.
8. [14- 303[D]
Acreage of lots. County records on GIS Web indicate that the lot
acreage for the parcel of record owned by Curnutte differs from the
number (acreage) shown. County records indicate 0.9550 acres for
the property of Heidi D. Curnutte on TMP 128A1 -30. The legal
references provided (DB 3119 P 636, DB 3174 P 179, DB 1487 P
469 plat, DB 612 P 404 plat) indicate the same. Please confirm
acreages shown for both TMP 128A1 -30 and TMP 128A1 -33. Once
acreages have been verified one way or the other, please provide a
photocopy of the deed referring to the precise and correct acreages
for each TMP or other similar evidence/ justification based on field
survey results with your revision submittal. Otherwise, please revise.
0.962 acres does not appear to he correct.
Revision #1— 02/24/12: Results of current field run survey and
justification accepted.
9. [14 -400]
Minimum lot requirements. TMP 128A1 -30 owned by Heidi D.
Curnutte does not meet minimum lot requirements for minimum
frontage requirements in RA zoning. However, since the degree of
nonconformity for this nonconforming lot remains unchanged, no
change to meet minimum frontage is required. Please do show either
graphically or in a note the setbacks required in RA zoning.

10. General: In reference to the question posed by Lori Meistrell regarding the
use /labeling of the area of land being "swapped," the use of "Parcel
A" and "Parcel B" is, in fact, confusing. This wording makes it
appear that Parcel 33A and 33B are being created, which currently
do not exist. Please refer to the areas of land being exchanged by
boundary line adjustment as "0.10 acre portion of TMP 128A1 -30"
and "0.10 acre portion of TMP 128A1 -33C," or similar language
chosen at the discretion of the surveyor in consultation with the
owners. This minor edit to the wording is a highly recommended, but
is not required. Once this wording is revised, please also revise the
notes regarding lot combination to follow suit.
