NOW, THEREFORE, IN CONSIDERATION of the foregoing premises and TEN DOLLARS($10.00)and other good and valuable consideration,the receipt of all of which is hereby acknowledged,the Grantor does hereby GRANT and CONVEY with SPECIAL WARRANTY OF TITLE,unto HIC,and its respective successors and assigns,those certain perpetual,non-exclusive rights of way and easements described as(i)those certain easements twenty feet(20')in width shown and designated on Sheet 8 of 25 of the Pavilions I Plat as "Existing 20'Public Drainage Easement" extending in an easterly direction form the eastern boundary of Rolkin Road near its intersection with Olympia Drive,and as"Existing 20'Public Drainage Easement"and"Existing 20'Private Drainage Easement"extending in a northeasterly direction from the eastern boundary of Rolkin Road,all as more particularly shown on the Pavilions I Plat,and(ii)that certain easement designated as"Existing Stormwater Management Easement"within Parcel L,as more particularly shown on the Pavilions I Plat and also shown as "Existing Stormwater Management Easement" on the Plat, to construct, install,maintain,repair,replace and extend stormwater drainage lines,structures and facilities,and 2 safe storm drainage installation,operation,and maintenance. Grantee shall have no responsibility to NPT to replace or reimburse the cost of said trees,brush,shrubbery or obstructions if cut,removed or otherwise damaged. Grantor reserves the right to subsequently dedicate such stormwater drainage lines,structures and facilities,and stormwater detention and water quality pond and facilities,to public use.Upon the subsequent acceptance of said lines, structures and facilities and appurtenances by Albemarle County,Grantee agrees to execute any further documents requested by Albemarle County in order to confirm the terms of said easements and to effect such acceptance. Until such time as such stormwater management facilities and structures, including stormwater detention and water quality pond and facilities,and related drainage lines(collectively, the "Stormwater Management Facilities")located on the applicable portions of the NPT Parcel are accepted for public maintenance, the costs of any private maintenance thereof (including any necessary maintenance,repair,or replacement thereof)may be allocated among the owners of parcels which use and are benefited thereby on a pro rata basis,based on each such parcel's calculated pro rata share of stormwater which drains to the Stormwater Management Facilities. NPT, or any successor owner of the Stormwater Management Facilities,shall have the right to: (i)determine the timing and necessity of such required maintenance; (ii) invoice each owner of a parcel which uses and benefits from such Stormwater Management Facilities for its pro rata share of maintenance thereof,which invoice shall be accompanied by reasonable documentation of the costs and expenses thereof and of the calculation of such parcel's pro rata share,which amount shall be paid by such owner within thirty (30) days following delivery of such invoice; and (iii) record a notice of nonpayment and lien("Notice of Lien")in the aforesaid Clerk's Office if the parcel owner shall fail 4 NORTH PANTOPS TOWNHOUSES, LLC, a Virginia limited liability company By: Charles Wm.
