Perez, Senior Planner Division: Current Development Date: March 19, 2012 Subject: SUB 2012 – 00031 Montgomery Bird Woods – BLA Plat The County of Albemarle Division of Current Development will grant or recommend approval of the Boundary Line Adjustment plat referenced above once the following comments have been addressed: [Each comment is preceded by the applicable reference, which is to the Subdivision /Zoning Ordinances unless otherwise specified.] 1. [14- 302(B)(7)] Agricultural Forestal District. It appears that portions of the property are in the Hardware Agricultural Forestal District. Please revise sheet 1, note G to reflect this. Also on the plat please distinguish which portions are in and which portions are out of the district for each property. 2. Assure "Parcel H" is an accurate description of Tax Map 88 Parcel 20. According to County Records and previous plats of record the parcel is labeled solely as Tax Map 88 Parcel 20. Revise if necessary. 3. [14- 302(B)(1)] General Information. When the plat is revised, please provide the date of the last revision on the plat. Below I have provided additional comments which are not related to plat revisions but may be beneficial for the land owner to be aware of. TMP 88 -20B will have 2 acres that are not in the Hardware Agricultural Forestal District, at least until they add those acres in by application. Also, if the land owners are relying on having 20+ acres in the Agricultural Forestal District to qualify them for the land -use tax program, they could lose that qualification between the time the BLA is recorded and the time that they add it back to the Agricultural Forestal District. They'll need to talk to the Assessor's office to get the details on this, since the office of Community Development does not administer that tax program. TMP 88 -20 will have 2 acres subject to the Agricultural Forestal District regulations, and they won't be able to remove the land from the district (assuming they want to) until the Hardware district is next up for review — roughly September of 2017.
