[Each comment is preceded by the applicable reference to the Subdivision Ordinance, unless otherwise specified.] 1. [14- 302(A)9] Building sites on proposed lots. Please add the building site note: "Parcel [letter or number] and the residue of Tax Map /Parcel [numbers] Each contain a building site that complies with section 4.2.1 of the Albemarle County Zoning Ordinance." COMMENT ADDRESSED 2. [14- 302(A)10] Right of further division of proposed lots. Please add the development rights note verbatim with applicable numbers: "Parcel [letter or number] is assigned [number] development rights and may /may not be further divided and when further divided these rights shall not comprise more than [number] acres. The residue of Tax Map/Parcel [numbers] is retaining [number] development rights and when further divided it shall not consist of more than [number] acres." REVISION #1: This comment is not addressed. The above statement is incomplete /not verbatim. Please research deeds as applicable and revise. REVISION #2: This comment is not addressed. The acreage in the development rights note should not be rounded off to the nearest whole number. Revise 27 acres to 27.65, which is the acreage listed for the residue. 3. [14- 302(B)1] General information. Please add date of last revision to plat when revisions to requested changes are submitted. REVISION #1: This comment is not addressed. Please add a revision date of 2/6/12 and a date of last revision to the plat for each revision. REVISION #2: This comment is not addressed. Please add revision dates on or before 2/6/12, 3/8/12, and with each revision submitted. 4. [14- 302(B)2] Name of plat preparer. Company information does not suffice. Please add the name of the individual who is the plat preparer. REVISION #1: This comment is not addressed. An individual name and seal with license number needs to be shown. At the option of the surveyor, revision copies may have an individual name and seal with license number that are shown with a "For Review" label. However, the signature copy of the plat needs to have the individual name and seal with license number of the plat preparer /surveyor. Company name and info does not suffice. Final approval of the plat will be contingent on having the name and seal of the plat preparer /surveyor shown. REVISION #2: Comment above still applies. 5. [14- 302(B)5] Zoning classification (including all applicable zoning overlay districts). Please add State Scenic Byways designation under zoning. COMMENT ADDRESSED 6. [14- 302(B)7] Reservoir watershed; agricultural- forest district; Please add a note that this property is located in a water supply protection area. Please also add a note that this property is not located in an agricultural- forest district. COMMENT ADDRESSED 7. [14- 302(B)8] Yards. Please show setbacks graphically or describe them in a note. COMMENT ADDRESSED 8. [14- 302(B)10] Stream buffers. Please add stream buffers note verbatim: "The stream buffer(s) shown hereon shall be managed in accordance with the Albemarle County Water Protection Ordinance." REVISION #1: "Agency" is the incorrect word. Please correct the word "Agency" to be "Ordinance." The stream buffers note has to be verbatim. REVISION #2: COMMENT ADDRESSED 9. [14- 303(D)] Acreage of lots. Please explicitly state total acreage of existing lot. COMMENT ADDRESSED 10. [14- 303(F)] Identification of sections, blocks, and lots. Lots shall be identified by numbers. Please choose a number rather than a letter for the lot currently called Lot A. COMMENT ELIMINATED 11. [14- 303(Q)] Water supply. This property is not within the service authority jurisdictional area. Please add a note: "Under current county policy, public water and sewer service will not be available to this property." COMMENT ADDRESSED 12. [14- 303(S)] Control points. Please add a minimum of 4 control points that are evenly distributed across the property. REVISION #1: (no change in status) REVISION #2: (no change in status) [14 -309] Soil evaluations. The Health Director has been contacted, but a decision has not been made regarding whether or not the sewage disposal system operation permit will suffice for meeting this requirement. Soil evaluations will be required unless the permit is deemed adequate. (Notification pending...) REVISION #1: Soil evaluations are required. Please submit soil evaluations for review and approval by the Health Dept. REVISION #2: Soil evaluations have been received. COMMENT ADDRESSED. 14.114-3101 Health director approval of individual private wells and /or septic systems. See comment immediately above. REVISION #1: (no change in status) REVISION #2: Health Dept. approval is received. COMMENT ADDRESSED. 15. [14 -316] Approval of entrance onto public streets. Final plat approval subject to VDOT approval of entrance onto public streets. REVISION #1: A review was done by VDOT, but clarification is needed. This comment may be eliminated upon consultation with the VDOT reviewing engineer. Notification to applicant of status is pending. REVISION #2: No objections from VDOT has been received. COMMENT ADDRESSED. 16. [14- 410/14- 412(A)(4)] Standards for all streets and alleys /Streets serving family or two -lot subdivisions. Please add a note, including applicable language from the following: "The existing and /or proposed right -of -way is of adequate width and horizontal and vertical alignment to accommodate a travelway passable by ordinary passenger vehicles in all but temporary extreme weather conditions, together with area adequate for maintenance of the travelway, as required by section 14 -412 of the Albemarle County Code." REVISION #1: (no change in status) REVISION #2: COMMENT ELIMINATED as discussed. 17. [14- 212(B)] Family subdivisions; conditions of approval. The subdivider shall place a restrictive covenant on the lots created by the family subdivision prohibiting the transfer of the lots so created to a person who is not a member of the immediate family for the retention period after the date of recordation. A template for this covenant is attached. Please submit a draft of this restrictive covenant. I will review and forward to County Attorney for his review. REVISION #1: Minor edits have been requested by the County Attorney's office. Please revise and submit a notarized copy of the restrictive covenant requested above for review and final approval. REVISION #2: Minor edits have been supplied and are acceptable. 18. [14- 212(C)] Principal means of access. Please see comment #15 above. REVISION #1: A review was done by VDOT, but clarification is needed. This comment may be eliminated upon consultation with the VDOT reviewing engineer. Notification to applicant of status is pending. REVISION #2: No objections from VDOT has been received. COMMENT ADDRESSED. 3 19. [14- 212(D)] Family subdivision standard note. Please add a note: "No lot shown on this family subdivision plat may be sold or conveyed to a person other than an eligible `member of the immediate family,' as that term is defined in Chapter 14 of the Albemarle County Code, for a period of four (4) years after the date of recordation of this plat except as authorized by section 4- 212(A) of the Albemarle County Code. If any lot created by the recordation of this plat is conveyed back to the grantor during the four (4) year period, it shall be recombined with the parent lot within six (6) months after such conveyance." COMMENT ADDRESSED 20. Additional Requirements. Verification of Family Division must be submitted with the final plat. Please submit a copy of affidavit, deed, or letter from attorney stating" the grantee, grantor and their relationship; and certifying that this is a Family Division in accordance with Section 14 -208 and related provisions of the Albemarle County Code. A template is attached. COMMENT ADDRESSED: Approval has been received by the County Attorney's office. *Status Update: Groundwater assessments are still pending and will be made available to the owner /applicant /owner's representatives once they are provided to the planner.
