RE: SUB - 2012 -034 Bentivar, Lot 20 — Final Subdivision Plat
Dear Sir or Madam:
Pursuant to Section 10.3.1 of Chapter 18 and Section 104 of Chapter 14 of the Albemarle County Code,
the above referenced subdivision plat has been denied. Tax Map 46 Parcel 130 (Lot 20), which is
depicted on the subdivision plat referred to above does not have any remaining development rights
associated with it, thus subdivision of the property is not possible.
Parcel History: portions of this parcel were originally part of Bentivar Phase I. In 1997 Bentivar Phase II
was approved as a Rural Preservation Development. As a condition of that approval several lots (lots
129, 130 and 147) were combined to form the current lot know as Tax Map 46 Parcel 130 (Lot 20). The
development rights for the previously existing lots were used in the Rural Preservation Development
known as Bentivar Phase H.
The approved /recorded final plat (DB 1666 — 23 8) for Bentivar Phase II states on sheet 2 of the final plat
for Tax Map 46 Parcel 130 (Lot 20) "May Not be Further Subdivided No Division Rights Remaining ".
Thus no further division of Lot 20 is permitted and the subdivision under review in our office is
denied.
No additional review of the plat has been performed to determine what, if any, other deficiencies the plat
may have. You may appeal this denial as provided for in Chapter 14, Section 213 of the Code of
Albemarle. The fee for an appeal is $270. Please contact me at your earliest convenience if you have any
