The recommended frontage improvements as shown in the study can be included in the amendment to the site plan if the county approves the rezoning. 2. Any entrances that do not meet the Access Management Spacing requirements will have to be relocated or the applicant will have to apply for a spacing exception. Torrey Road Lyndhurst, VA 22943 RE: ZMA 2011 - 00008, Three Notch'd Center- Application Plan Amendment Dear Ms. Higgins: Staff has reviewed your initial submittal for an amendment to the rezoning plan for the property at Three Notch'd Center (ZMA2007 -006). We have a few questions and comments, which are listed below: Planning This is an amendment to an existing rezoning plan (ZMA2007 -006). Comments below are provided on the specific changes to the plan. Planning Comments 1. The proffers need to be updated to include reference to the latest application plan and date. Zoning The following comments related to zoning matters have been provided by Francis MacCall: Provide a new parking analysis since there was one done for reduction of spaces for the previous rezoning. The new building takes up a number of spaces that were part of the final approved plan. Current Development 1. A more complete and legable plan should be submitted. It is difficult to identify how the circulation will work on the existing site. Engineering and Water Resources The revised rezoning plan and application to add a car wash to this site have been reviewed. The following items have been identified concerning the rezoning amendment; ZMA 2011 - 00008, Three Notch'd Center, First Comment Letter, Jo Higgins- January 20, 2012 2 Off -site easements or letters of permission from the owner of TM56A3 -7 are needed in order for this plan to be accomplished. Drainage releases and stormwater management are on the other parcel. 2. A travelway connection is recommended to the Albemarle Storage LLC site, in order to consolidate entrances on the public road. 3. It is noted that the stormwater basin on the Albemarle Storage site may require modifications to serve this site as proposed. 4. It is recommended that additional water quality measures be proffered beyond what might normally be required through the Water Protection Ordinance. 5. Previous zoning reviews of this development have looked at left turn requirements on Rt. 240. Turn lane improvements would improve the safety and capacity along this corridor. 6. This plan revision does not appear to provide the minimum information recommended by the Planning Commission and the Board in the past. It is recommended that a more complete and legible plan be provided. VDOT 1. Route 240 is functionally classified as a Rural Minor Arterial. VDOT records indicate that the road is 35 mph but it is posted at 25 mph. 2. The required spacing for a full access commercial entrance at 25 mph is 355 feet and 35 mph is 470 feet. It appears that there is enough frontage on Route 240 to meet the spacing requirements. 3. The increase in traffic from this proposed use is 166 VPH in the peak hour. A right and left turn lane analysis needs to be provided for review in accordance with Appendix F of the VDOT Road Design Manual. ASCA /RWSA See attached comment letter. Proffers The proffers that were signed before will need to be updated to reference the new application plan and plan date. Action after Receipt of Comments After you have read this letter, please take one of the actions identified in the attachment "Action After Receipt of Comment Letter." Resubmittal If you choose to resubmit, please use the attached form. There is no fee for the first resubmittal. The resubmittal date schedule is provided for your convenience. Notification and Advertisement Fees ZMA 2011 - 00008, Three Notch'd Center, First Comment Letter, Jo Higgins- January 20, 2012 Recently, the Board of Supervisors amended the zoning ordinance to require that applicants pay for the notification costs for public hearings. Prior to scheduling a public hearing with the Planning Commission, it appears that these fees have already been paid: $ 220.80 Cost for newspaper advertisement $ 203.29 Cost for notification of adjoining owners (minimum $200 + actual postage /$1 per owner after 50 adjoining owners) $ 424.09 Total amount due prior to Planning Commission public hearing Prior to the Board of Supervisor's public hearing, payment of the newspaper advertisement for the Board hearing needed. $ 220.80 Additional amount due prior to Board of Supervisors public hearing $ 644.89 Total amount for all notifications Fees may be paid in advance. Payment for both the Planning Commission and Board of Supervisors public hearings may be paid at the same time. Additional notification fees will not be required unless a deferral takes place and adjoining owners need to be notified of a new date. The staff report and recommendation will be based on the latest information provided by you with your initial submittal or resubmittal. Please remember that all resubmittals must be made on or before a resubmittal date. By no later than twenty -one (21) days before the Planning Commission's public hearing, a newspaper advertisement fee and an adjoining owner notification fee must be paid. (See attached Fee Schedule) Your comment letter will contain the actual fees you need to pay. Payment for an additional newspaper advertisement is also required twenty -two (22) days prior to the Board of Supervisors public hearing. These dates are provided on the attached Legal Ad Payments for Public Hearings form. Please be advised that, once a public hearing has been advertised, only one deferral prior to the Planning Commission's public hearing will be allowed.during the life of the application. The only exception to this rule will be extraordinary circumstances, such as a major change in the project proposal by the applicant or more issues identified by staff that have not previously been brought to the applicant's attention. As always, an applicant may request deferral at the Planning Commission meeting. Virginia State Code requires that. notice for public hearings be made by publishing a legal advertisement in the newspaper and by mailing letters to adjacent property owers. Therefore, at least two fees for public notice are required before a Zoning Map Amendment may be heard by the Board of Supervisors. The total fee for public notice will be provided to the applicant after the final cost is determined and must be paid before the application is heard by a public body. SP- 2011 -00031 Greenbrier Emergency Animal Hospital (Joanne Purtsezva) 1. The estimated increase in traffic for this use is 50 to 60 VPH in the AM and PM peak hours. It is not clear whether this is an increase in traffic or just a change to a new use that will have no net effect on traffic. ZMA- 2011 - 00008, 00009 Three Notched Center (Megan Yaniglos) 1. Route 240 is functionally classified as a Rural Minor Arterial. VDOT records indicate that the road is 35 mph but it is posted at 25 mph. 2. The required spacing for a full access commercial entrance at 25 mph is 355 feet and 35 mph is 470 feet. It appears that there is enough frontage on Route 240 to meet the spacing requirements. 3. The increase in traffic from this proposed use is 166 VPH in the peak hour. A right and left turn lane analysis needs to be provided for review in accordance with Appendix F of the VDOT Road Design Manual. ZMA- 2011 -00010 Albrecht Place (Claudette Grant 1. ITE trip generation estimates that this use will generate 3400 vehicles per day on weekdays and 4700 VPH on Saturdays. 2. The applicant has indicated that the view of the car wash will be completely blocked when Phase 3 (the western building) is completed. However, views of the car wash will still be available at the western entrance into the site, and possibly from vantage points west of the site (for approximately 400') at the completion of Phase 3. Also, there is no established timeframe for the construction of the office /retail buildings. Consequently, the Phase 1 and 2 visibility can't be considered temporary. The applicant has indicated that the car wash exterior will be designed with the materials that were approved by the ARB for the Three Notch'd Center buildings. This is a good first step toward establishing compatibility, but additional measures will be required to establish an appropriate appearance for this car wash in the EC. Typical car wash structures can incorporate elements that do not have an appropriate appearance, such as but not limited to: • a functional form and appearance with no reference to historic architecture • materials with an unfinished appearance • overly bright and glaring lighting • extensive equipment, often with bold colors, signs and illumination It is anticipated that an ARB - approvable design will exhibit a balance of required car wash features positioned for reduced visibility, EC- compatible architectural features (forms, materials and details), and screening elements. Because the appearance of the car wash is unknown at this time, it is recommended that the revised concept plan include: Additional designated landscape areas on the south, east and west sides of the car wash site (even if the plants would have to be moved to accommodate future development phases) A designated location, not visible from the EC, for equipment (vacuum machines, vending machines, etc.) 3. An appropriate statement regarding the intended amount, character and intensity of lighting associated with the car wash structure and site ARB review and approval of the site plan amendment (building and site design) will be required prior to final site plan approval. The applicant has indicated that 18 parking spaces will removed from the plan to accommodate the car wash, and the square footage of the office /retail buildings will be reduced to offset the lost parking spaces. Changes to the architectural design of the office /retail buildings to accommodate the reduced square footage should be included in the ARB site plan amendment submittal.
