Dear Ms. Knox,
Thank you for the recent application for this special use permit. Please find review comments included in
this letter.
Please see the attached resubmittal schedule for a list of dates on which you can submit your revisions and
responses to review comments (below and attached), as well as for possible Planning Commission dates
(please note that the listed dates are the earliest possible, but actual dates need to be selected to suit the
revision schedule for each project.)
COMMENTS
Planning (Scott Clark)
Two different plans were submitted with the application — one in color and one in black and
white. Please specify which one the application refers to. If it is the black- and -white plan, the
lights should be labeled rather than highlighted, as highlighting will not transfer to future copies
of the plan.
Is the light on the entrance road at the top of the vineyard a fixed light or a mobile tower? A
generator running in that location could be audible at the nearby dwelling.
Please see Zoning's comments below about the number of parking spaces. We would recommend
that the total number be reduced somewhat (still allowing for employees etc.) by removing those
spaces closest to the eastern boundary of the property, which are the ones most likely to create
impacts on neighboring properties.
Zoning (Francis MacCall)
The maximum event size proposed is 550 persons. The parking requirement is 1 space per 2.5
participants and 1 space per employee, which includes staff, caterers, musicians and vendors.
The number of participants will require 220 spaces. Please provide the number of employees so
that a final number can be figured. For example if you had 20 employees then the required
parking would be 240 spaces. The ordinance allows for no more than 20% more than the
required amount. Thus if 240 spaces are required then 48 additional spaces may be provided,
totaling 288. The site shows over 300. Please bring the number of spaces provided down to no
more than the permitted maximum.
Please differentiate between existing parking and the new parking being added for the events.
There appears to be about 6 parking spaces that are within the 25' setback, please correct this by
moving them out of the setback. There also appears to be some spaces that are grayed out within
that 25' setback as well that need to be removed entirely from the plan. Being that the parking
appears to be right upon the setback a condition may be required that would have the applicant
mark where the setback line is so as to avoid vehicle creep into the setback.
The application mentions 12 light poles. I can only find 11 on the plan. Labeling them with
words as well as makings as to location will help. The lighting specifications provided do not
appear to meet the requirement of being full cutoff luminarie. Please see section 4.17 of the
Zoning Ordinance for specific lighting requirements.
Fire /Rescue (Robbie Gilmer)
403.2 Public safety plan. In other than Group Aor E occupancies, where the fire code official
determines that an indoor or outdoor gathering of persons has an adverse impact on public safety
through diminished access to buildings, structures, fire hydrants and fire apparatus access roads
or where such gatherings adversely affect public safety services of any kind, the fire code official
shall have the authority to order the development of, or prescribe a plan for, the provision of an
approved level of public safety.
403.2.1 Contents. The public safety plan, where required by Section 403.2, shall address such
items as emergency vehicle ingress and egress, fire protection, emergency medical services,
public assembly areas and the directing of both attendees and vehicles (including the parking of
vehicles), vendor and food concession distribution, and the need for the presence of law
enforcement, and fire and emergency
medical services personnel at the event.
404.3.2 Fire safety plans. Fire safety plans shall include the
following:
1. The procedure for reporting a fire or other emergency.
2. The life safety strategy and procedures for notifying,
relocating or evacuating occupants, including occupants
who need assistance.
3. Site plans indicating the following:
3.1. The occupancy assembly point.
3.2. The locations of fire hydrants.
3.3. The normal routes of fire department vehicle
access.
4. Floor plans identifying the locations of the following:
4.1. Exits.
4.2. Primary evacuation routes.
4.3. Secondary evacuation routes.
4.4. Accessible egress routes.
4.5. Areas of refuge.
4.6. Exterior areas for assisted rescue.
4.7. Manual fire alarm boxes.
4.8. Portable fire extinguishers.
4.9. Occupant -use hose stations.
4.10. Fire alarm annunciators and controls.
5. Alist of major fire hazards associated with the normal use and occupancy of the
premises, including maintenance and housekeeping procedures.
6. Identification and assignment of personnel responsible for maintenance of systems and
equipment
installed to prevent or control fires.
7. Identification and assignment of personnel responsible for maintenance, housekeeping
and controlling
fuel hazard sources.
404.5.1 Distribution. The fire safety and evacuation plans shall be distributed to the tenants and
building service employees by the owner or owner's agent. Tenants shall distribute to their
employees applicable parts of the fire safety plan affecting the employees' actions in the event of
a fire or other emergency.
2403.2 Approval required. Tents and membrane structures having an area in excess of 400 square
feet (37 m2) shall not be erected, operated or maintained for any purpose without first obtaining a
permit and approval from the fire code official.
Exceptions:
1. Tents used exclusively for recreational camping purposes.
2. Tents open on all sides which comply with all of the following:
2.1. Individual tents having a maximum size of 700 square feet (65 m2).
2.2. The aggregate area of multiple tents placed side by side without a fire break
clearance of
12 feet (3658 mm), not exceeding 700 square feet (65 m2) total.
2.3. A minimum clearance of 12 feet (3658 mm) toall structures and other tents.
2403.5 Use period. Temporary tents, air - supported, air - inflated or tensioned membrane structures
shall not be erected for a period of more than 180 days within a 12 -month period on a single
premises.
They need to have in place a fire safety, evacuation and lock down plan on file.
VSFPC 404.3.2 Fire safety plans. Fire safety plans shall include the following:
1. The procedure for reporting a fire or other emergency.

occupants, including occupants who need assistance.

Architectural Review Board (Margaret Maliszewski)
The proposed farm winery events are not expected to have a negative impact on the Entrance
Corridor.
Virginia Department of Transportation
1. VDOT comments will be forwarded as soon as they are received.
Resubmittal or Public Hearing
Within 30 days of the date of this letter, please do one of the following:
(1) Resubmit in response to these comments on a resubmittal date as published in the project
review schedule (the full resubmittal schedule may be found at www.albemarle.org in the
"forms" section at the Community Development page). Please use the enclosed resubmittal
form; OR
(2) Request a public hearing be set with the Planning Commission based on the information
provided with your previous submittal (a date will be set in accordance with the Planning
Commission's published schedule as mutually agreed to by you and the County), OR
(3) Request indefinite deferral and state your justification for requesting the deferral. (Indefinite
deferral means that you intend to resubmit/request a public hearing be set with the Planning
Commission after the 30 day period.)
If we have not received a response from you within 30 days, we will contact you again. At that time, you
will be given 10 days to do one of the following: a) request withdrawal of your application, b) request
deferral of your application to a specific Planning Commission date as mutually agreed to with staff, or c)
request indefinite deferral and state your justification for requesting the deferral. If none of these actions
is taken, staff will schedule your application for a public hearing based on the information provided with
your original submittal.
Please be advised that, once a public hearing has been advertised, only one deferral prior to the Planning
Commission's public hearing will be allowed during the life of the application. The only exception to
this rule will be extraordinary circumstances, such as a major change in the project proposal by the
applicant or more issues identified by staff that have not previously been brought to the applicant's
attention. As always, an applicant may request deferral at the Planning Commission meeting.
