Barwick, III From: Joanne Tu Purtsezova Division: Planning Received Date: March 28, 2012 Review Date: April 11, 2012 Subject: SUB201200029 — Barwick - BLA Fax: 434 - 972 -4126 The Albemarle County Planning Division will grant or recommend approval of the boundary line adjustment plat referenced above once the following comments have been addressed. The following comments are those that have been identified at this time. Additional comments may be added or eliminated based on further review. [Each comment is preceded by the applicable reference to the Subdivision Ordinance, unless otherwise specified.] 1. [14- 302(A)4] Private easements. Show any and all private easements on properties affected by the boundary line adjustment. Label these as private. REVISION #1: Deed research by the planner indicates that several easements exist that are not shown on the current plat. Complete thorough deed research and show any and all private easements on properties affected by the boundary line adjustment. 2. [14- 302(A)5] Public easements. Show any and all public easements on properties affected by the boundary line adjustment. Label these as public. REVISION #1: Deed research by the planner indicates that several easements exist that are not shown on the current plat. Complete thorough deed research and show any and all public easements on properties affected by the boundary line adjustment. 3. [14- 302(A)9] Building sites on proposed lots. Show the location and area of potential (30,000 square feet, rectangular) building sites to demonstrate that building sites exist as indicated by the accompanying note on the front sheet. REVISION #1: Comment addressed. 4. [14- 302(A)10] Right of further division of proposed lots. Provide the development rights note, regardless of whether or not development rights are being affected by this plat. Provide a correct development rights note, that reads, "Parcel [letter or number] is assigned [number] development rights and may /may not be further divided and when further divided these rights shall not comprise more than [number acres. The residue of Tax Map /Parcel [numbers[ is retaining [number] development rights and when further divided it shall not consist of more than [number] acres." Include all applicable portions of this note. Modify the note minimally only in instances where the note will be made more clear, since the ordinance language does not fit the boundary line adjustment precisely. REVISION #1: Development rights note appears to be correct. Deed and plat research indicate that no further division is permitted without Planning Commission approval. 5. [14- 302(A)11] Instrument creating property proposed for subdivision. An unrecorded plat may not be a plat reference. Research and list appropriate and correct deed and plat references. REVISION #1: Comment addressed. 6. [14- 302(A)15] Identification of all owners and certain interest holders. Last names only are not sufficient for the property owner information. Include first and last names, as well as middle initial and /or middle name, if known. Names and accompanying information need to match tax records. REVISION #1: Comment addressed. 7. [14- 302(B)1] General information. Add the date of last revision with each re- submittal. REVISION #1: Date of last revision noted for revision #1. Add a date of last revision with each re- submittal. 8. [14- 302(B)2] Name of plat preparer. Add the name of the individual who prepared the plat, including a seal. REVISION #1: Comment addressed. 9. [14- 302(B)7] Reservoir watershed; agricultural forestal district. Preddy Creek is not the reservoir or water supply watershed. It is a sub - watershed. Remove all of these notes. Indicate that TMP 21 -34 is not located in a reservoir watershed. Indicate that TMP 21 -34D is not located in a reservoir watershed. Indicate that TMP 21 -34E is not located in a reservoir watershed. REVISION #1: Comment addressed. 10. [14- 302(B)10] Stream buffers. Show the location of all streams and stream buffers with the accompanying note, verbatim. REVISION #1: Comment addressed. 11. [14- 303(L)] Public utility, drainage and sight distance easements. Remove the note that reads, "Utilities and easements other than those shown hereon may exist." Show any and all public utility, drainage and sight distance easements that exist. REVISION #1: Deed research by the planner indicates that several easements exist that are not shown on the current plat. Complete thorough deed research and show any and all public utility, drainage, and sight distance easements on properties affected by the boundary line adjustment. 12. [14- 303(A)] Statement of consent to division. Remove the sub from "subdivision" in the statements of consent to division under each Owners Approval panel. This note has to be verbatim.
