Vest Applicant: Verizon Wireless c/o Lori Schweller From: Joanne Tu Purtsezova Division: Planning Date: May 14, 2012 Subject: SDP201200025 — Tier II PWSF: Verizon Wireless, Vest Property /Hardware River Fax: 434- 972 -4126 The Albemarle County Planning Division will approve the Tier II personal wireless service facility referenced above once the following comments have been addressed. The following comments are those that have been identified at this time. Comments may be added or eliminated based on further review. [Each comment is preceded by the applicable reference to the Wireless Ordinance of the Albemarle County Code, unless otherwise specified.] 1. [5.1.40(a)(1)]/[5.1.40(a)(3)] Completed application form /Signing authorization. The application form is not signed by the parcel owner. Provide the signature of the parcel owner to complete the application form or submit written evidence that the parcel owner's agent may sign the application. 2. [5.1.40(a)(4)(g)] Setbacks. Note the side yard setback. 3. [5.1.40(b)(2)] Fall zone easement. A draft copy of a fall zone easement has been provided as a miscellaneous submittal on May 9, 2012 during the balloon test. County Attorney's review is pending. 4. [5.1.40(c)8] Critical Slopes. Critical slopes may not be disturbed in association with installation of the wireless facility. A critical slopes waiver has been requested. Review and a recommendation of approval by the County Engineer or designee to the Board of Supervisors is required. The planner will also review the critical slopes waiver request and provide a recommendation to the Board of Supervisors. Following the Sinclair vs. County of Albemarle (Virginia State Supreme Court) case, Board of Supervisors review and approval of the critical slopes waiver is required. Retaining walls, revetments, and other stabilization measures employed must be acceptable to the County Engineer and the Board of Supervisors. Review of the critical slopes waiver is pending. 5. [5.1.40(d)] Tier II Review by the Planning Commission. Planning Commission review of this wireless facility is pending. Obtain Planning Commission approval. Although the parcel is located in the Entrance Corridors, the design planner for the Architectural Review Board has no objections to this wireless facility since the tower site is not located in the Entrance Corridors. 6. [5.1.40(d)(5)] Maximum diameter at the top of the monopole. The maximum diameter at the top of the monopole must be 18 inches. 7. [5.1.40(d)(8)] Vertical cables, wiring, and similar attachments. On sheet C -3. a steel monopole is replacing the existing wood monopole, so note #5 under General Notes does not apply. Remove note #5 and replace it with a note that metal monopoles shall be constructed so that vertical cables, wiring and similar attachments are contained within the monopole's structure.
